Abstract:

Anotace Tato diplomová práce se nazývá Sankční systém trestního práva a zabývá se popisem a hodnocením jednotlivých institutů systému trestních sankcí. Cílem práce je snaha o vystižení základních charakteristik systému trestních sankcí podle zákona č. 40/2009 Sb., trestní zákoník, včetně jeho změn po poslední novelizaci provedené zákonem č. 330/2011 Sb. Účelem práce je podat základní charakteristiku a popis celého platného systému sankcí, tedy jak trestů, tak i ochranných opatření. Práce není zaměřena speciálně na žádný z těchto trestněprávních institutů, ale u všech je podán jejich základní popis a charakteristika. V úvodu práce jsou uvedeny obecné principy a základní rysy společné oběma těmto druhům trestněprávních sankcí a následně je podán popis jejich jednotlivých specifik a typických zvláštností. Práce obsahuje úplný výčet všech druhů trestů i ochranných opatření a v případě odlišností ve vztahu k předchozí právní úpravě jsou zmíněny i tyto změny. Práce je zaměřena na trestní sankce ukládané v případě dospělých pachatelů trestných činů, ale u některých sankcí nechybí ani zmínka o zvláštnostech jejich ukládání v případě mladistvých pachatelů provinění. Závěr práce obsahuje zhodnocení současného sankčního systému trestního práva jako celku i některých jeho jednotlivých institutů. Součástí závěrečného zhodnocení je také několik osobních názorů na problematiku současného trestání a několik návrhů na možné zlepšení situace v případě nedostatků některých druhů trestů.

Abstract:

Annotation The name of this diploma work is Criminal Law System of Sanctions and it is addressing evaluation of individual institutes of the system of the criminal sanctions. The target of this work is an attempt to apply the main characteristics of the system of the criminal sanctions according to the law # 40/2009 Sb., penal code, including its changes after the last amendment executed by the law # 330/2011 Sb. The purpose of this work is to show the main characteristic and the description of the whole effective system of sanctions, that means not only the penalties but also protective arrangements. This work is not focused especially on any one of these criminal law institutes but with all of them comes their main description and characteristic. In the introduction of this work you can see the general principles and the main features that are common with both of these kinds criminal law sanctions and afterward you can see a description of their own specific and typical rarity. This work includes complete list of all the kinds of penalties and protective arrangements and in case of any differences in the relation with previous legal adjustment there are also mentioned these changes. The work is focused on the law sanctions that are given in cases of adult offenders of the crimes but in some sanctions there is also a note about the rarities that are given in cases of young offenders. The conclusion of this work contains the evaluation of the present Criminal Law system of Sanctions as a unit and also some of its individual institutes. A part of the final evaluation are also some personal opinions related to the present punishment and some suggestions how to improve the situation in case of a deficiency in some cases of penalties.
