Non-competiton clause in labour relations

Abstract:

Diplomová práce se zaměřuje na problematiku konkurenční doložky uzavírané v pracovněprávních vztazích, především jako na institut sloužící k ochraně oprávněných zájmů zaměstnavatele. Autorka provádí posouzení předmětného institutu za pomocí rozboru právní úpravy, výstupů rozhodovací praxe soudů a odborné literatury. Úhlem pohledu ochrany zaměstnavatele jsou zhodnoceny stanovené obsahové a další podmínky konkurenční doložky, působnost konkurenční doložky z hlediska rozsahu omezení činnosti bývalého zaměstnance, podmínky uplatnění sjednané smluvní pokuty a možnost odstoupení zaměstnavatele.

Abstract:

The diploma thesis focuses on the issue of non-competition clauses concluded in labor relations, primarily as an institute serving to protect the legitimate interests of the employer. The author assesses the institute in question with the help of an analysis of legislation, outcome of the decision-making practice of courts and professional literature. The specified content and other conditions of the non-compete clause are evaluated from the point of view of the employer's protection. As well as, former employee's restriction of remunerated activity, the conditions for applying the agreed contractual penalty and the possibility of withdrawal.
