Rights and Obligations of Legal Firearms Holders and Their Police Control

Abstract:

Diplomová práce „Práva a povinnosti legálních držitelů zbraní a jejich policejní kontrola“ se zabývá právy a povinnostmi osob, které jsou držiteli zbrojních průkazů a zbraní, včetně aspektů jejich kontroly ze strany Policie České republiky. Začátek práce charakterizuje základní pojmy a principy, které jsou nezbytné k pochopení celé oblasti zbraní a střeliva u nás. Poté je pozornost soustředěna na jednotlivá oprávnění a povinnosti, která jsou taxativně uvedena v zákoně o zbraních a střelivu a také na ta, která ze zákona logicky vyplývají. V textu je patrné i propojení s trestním právem, kdy bude zmíněna i možnost nutné obrany a krajní nouze, tedy práva na použití zbraně při sebeobraně. Dále následuje rozbor aspektů policejní kontroly, jak ze strany příslušných útvarů, tak ze strany informačních systémů. Závěr práce má za cíl zjistit vztah běžných občanů České republiky ke střelecké veřejnosti. Dále zjistit možné dopady Evropské směrnice a také to, zda je snaha EU o odzbrojení občanů, vzhledem k bezpečnostním rizikům, vhodná. Na základě řízených rozhovorů a analýzy statistických dat jsou navrhnuta některá opatření, která by u nás mohla zlepšit bezpečnost v této oblasti.

Abstract:

The master thesis „Rights and Obligations of Legal Firearms´ Holders and Their Police Control“ deals with rights and obligations of people who are holders of firearms certificates and guns, including the aspects of their control by the Police of the Czech Republic. The beginning of the thesis characterises the basic terms and principles which are necessary to understand the whole field of guns and ammunition in our country. Then the attention is drawn to individual rights and duties which are stated in the act on guns and ammunition that are subject to taxes, and those which result from the act logically as well. In the text there is also apparent the relation to criminal law, too, when the possibility of necessary defense and extreme emergency, the right of using a gun in self-defense is mentioned. After that an analysis of aspects of police control follows up, carried out by appropriate departments and media as well. The conclusion of the thesis aims to find out the Czechs´ relations to gun holders and possible impacts of the European directive, concerning disarmament of citizens, if it is useful in relation to safety risks. Based on structured interviews and statistical data analysis several measures are suggested to improve the safety in this field.
