Independence of the judiciary and its constitutional aspects

Abstract:

Tématem rigorózní práce je Nezávislost justice a její ústavní aspekty. Téma bylo vybráno s ohledem na jeho aktuálnost. Problematika nezávislosti justice se neustále vyvíjí. V České republice je v posledních letech aktuální zejména otázka posílení nezávislosti českého soudnictví zřízením autonomního soudního orgánu – tzv. soudcovské rady, po vzoru některých zemí EU. Myšlenka pojmout jako téma rigorózní práce právě problematiku nezávislosti justice se zrodila mimo jiné v důsledku současné diskuze odborné veřejnosti nad tímto tématem. Práce je zaměřena především na ústavní aspekty nezávislosti justice. Analyzuje příslušná ustanovení současné Ústavy ČR a jejich vliv na zajištění nezávislosti soudů a soudců. Práce začíná tímto stručným úvodem do problematiky tématu, následuje 5 hlavních kapitol a zakončena je hodnotícím závěrem. První kapitola je věnována objasnění pojmů nezávislost a nezávislost justice, a to zejména z filosofického hlediska. Pomáhá čtenáři pochopit, co si má představit pod danými pojmy i v jakém významu bývají nejčastěji vykládány. Institut nezávislosti justice je úzce spjat s teorií dělby státní moci, proto se práce dále věnuje jejich vzájemnému vztahu a podmíněnosti. Vznik a vývoj teorie dělby moci je popsán zejména z pohledů nejvýznamnějších filosofických autorů, kteří se na jejím vývoji podíleli. Část této kapitoly je věnována rovněž popisu dělby státní moci v ČR. Druhá kapitola pojednává o vývoji české ústavnosti od roku 1918 po současnost, a to se zaměřením na nezávislost soudnictví a jeho vývoj. Kapitola analyzuje jednotlivé historické československé a české ústavy. Zabývá se jejich vztahem k nezávislosti justice a hodnotí jej. Alespoň stručný popis historického vývoje ústavnosti je nezbytný pro správné pochopení obsahu dalších kapitol v historických souvislostech. Třetí kapitola je věnována přehledu aktuální právní úpravy, která zajišťuje nezávislost justice. Analyzuje příslušná ustanovení v aktuální Ústavě ČR a v nejdůležitějších zákonech, které mají k nezávislosti justice vztah a nemohou tak zůstat opomenuty. Čtenáři je nabídnut přehled stěžejní aktuální právní úpravy, judikatury Ústavního soudu ČR i vybraných mezinárodních dokumentů, které mají co do činění s nezávislostí justice. Čtvrtá kapitola je hlavní teoretickou částí. Popisuje právní instrumenty, které mají ústavní základ a slouží k zajištění nezávislosti justice. Obsahuje citace příslušných článků Ústavy ČR i souvisejících zákonů. Objasňuje pojmy nezávislost soudců a nezávislost soudů. Zabývá se ústavními a zákonnými požadavky na nestrannost soudců. Objasňuje, jakými limity jsou soudci vázáni při výkonu soudcovského povolání a čím se mají řídit při svém rozhodování. Obsáhlejší část této kapitoly je věnována procesu jmenování soudců do funkce a výběrem soudců vůbec. Právě tato problematika má přímou souvislost s nezávislým výkonem justice. Příslušná podkapitola popisuje, jak do tohoto procesu zasahují představitelé moci soudní a moci výkonné. Zabývá se otázkou, jaký je vhodný poměr participace soudní a výkonné moci na procesu výběru nových soudců. Vyjádřen je zde autorský názor na participaci moci výkonné a návrh, jak by model obsazování funkcí soudců mohl vypadat, aby byla participace moci výkonné a soudní vyvážená. Tendence by se přitom dle vyplývajícího názoru měly ubírat směrem k oslabení potenciálního vlivu prezidenta na jmenování kandidátů do funkcí soudců. nkcí soudců s výkonem jiných veřejných funkcí a kolidujících činností. Objasněno je, jaký význam má neslučitelnost funkcí pro nezávislost justice. Pozornost je dále věnována také neodvolatelnosti soudců, délce jejich mandátu a podmínkám zániku funkce. V souvislosti s tím jsou popsány výjimečné okolnosti, které mohou vést k zániku mandátu. Tato kapitola rovněž obsahuje pojednání o ochraně nezávislosti a nestrannosti soudců právními předpisy trestního práva. Pátá kapitola obsahuje autorskou úvahu o tom, nakolik je nezávislost justice podmíněna její samosprávou. Kladen je přitom důraz na zodpovězení otázky, zda důsledná samospráva justice může zajistit její skutečnou nezávislost. Tato část práce rovněž hodnotí současný stav a úroveň samosprávy justice v České republice. Podstatná část kapitoly je věnována zmapování diskuze odborné veřejnosti nad tématem nezávislosti justice a její samosprávy. Kapitolu uzavírá názor autora na samosprávu české justice z pohledu de lege ferenda. Celkově práce kombinuje poznatky o vývoji dané problematiky, nabyté především studiem historie československé a české ústavnosti, dále zanalyzované teoretické poznatky o současném stavu nezávislosti justice a instrumentech k jejímu zajištění a konečně názory odborné veřejnosti na danou problematiku.

Abstract:

The topic of this thesis is Independence of the judiciary and its constitutional aspects. This topic was chosen with regard to its actual relevance. The issue of the independence of the judiciary is constantly evolving. In recent years, a matter of strengthening the independence of Czech judiciary by establishing autonomous judicial body – Judicial Council (according to some EU countries) became especially relevant in the Czech Republic. The thesis is primarily focused on the independence of the judiciary and its constitutional aspects. It analyzes relevant provisions of the present Constitution of the Czech Republic and their influence on strengthening the independence of judges and courts. The work begins with a brief introduction to the topic, then continues with 5 main chapters and ends with an evaluating conclusion. The beginning of thesis is dedicated to an introduction to the independence of the judiciary. This chapter justifies author’s choice of this topic. It establishes the methodical procedures and goals that are pursued by author in this work. The first chapter is dedicated to the clarification of the term the independence of the judiciary, especially from philosophical point of view. It helps to understand this term from other perspective. The judicial independence institute is closely related to the theory of separation of state powers. Therefore, author deals further with theirs mutual relationship of conditionality. History of separation of powers is described specifically from the most important philosophical perspective that has participated on its evolution. The chapter’s conclusion describes the separation of state powers in the Czech Republic. The second chapter deals with the evolution of the Czech constitutionality from 1918 till present focusing on the independence of the judiciary and its evolution. This chapter analyzes particular historical Czechoslovak and Czech Constitutions. It deals with theirs relationship to the independence of the judiciary and evaluates it. Author considers the brief description of historical evolution of constitutionality important in order to correctly understand the content of further chapters. The third chapter is dedicated to the summary of present legislation which ensures the independence of the judiciary. It analyses relevant provisions in current Constitution of the Czech Republic and the most important legislation that is related to the independence of the judiciary. The chapter further contains the summary of main jurisprudence of the Constitutional Court related to the topic. The fourth chapter presents the main theoretical part. It describes the legal instruments that have constitutional background and are aimed to the independency of judiciary assurance. It contains the constitution and relevant legislation citations. It clarifies the terms such as the independence of judges and the independence of courts. It deals with the constitutional and legal requirements for the impartiality of judges. It clarifies the limits that are obligatory for judges in the administration of justice and in their ruling. The more detailed part of the chapter is dedicated to the procedures of judge appointment and selection of judges at all which is directly related to the independent execution of justice. At this point author describes the way representatives of judiciary and executive power interfere with this process. Author deals with a question what is suitable ratio of the judiciary and executive power participation in the process of the selection of new judges. Author expresses her opinion on the executive power participation in this process and suggests how the participation of the executive power and judiciary could be balanced. Author also expresses her opinion that the potential presidential influence on the appointment of candidates to the post of judges should be weakened. ar negative historical experience. The chapter further deals with the incompatibility of the office of judge and the execution of other public functions and conflicting activities. Author clarifies the importance of incompatibility of functions for the independence of the judiciary. The attention is paid as well to the irrevocability of judges, length of their mandate and conditions of termination of the judge’s post. It describes exceptional circumstances that can lead to the termination of judge’s mandate. This chapter also contains information about protection the independency and impartiality of judges due to legal acts of Criminal Law. The fifth chapter evaluates current status and level of the independence of the judiciary in the Czech Republic. It contains author’s idea how the independence of judiciary is connected with its autonomy. Author raises the question whether a consistent autonomy of judiciary can really ensure its independence. The chapter is also dedicated to the evaluation of the present state of autonomy of judiciary in the Czech Republic and maps the current professional debate over this topic. It deals with experts’ opinions in this field and evaluates the current initiatives that lead to the strengthening of the independence of judiciary. The chapter also expresses assumptions of consistent autonomy of judiciary in the way they are usually understood by the professional public. The thesis is overall combining the knowledge of topic’s history from the view of former Czechoslovak and present Czech Republic constitutionality, then theoretical knowledge of the current practice about organization of judiciary and author’s practical knowledge and opinions about this issue. The thesis was supposed to summarize historical consequences of Czech and Czechoslovak constitutional evolution in relation to the independence of the judiciary. A part of the thesis brings a digest of valid law for ensuring independence of the judiciary. The author´s intention was to introduce reader into the issue of constitutional instruments for strengthening of the independence of judicial power as well. The end of thesis is also a resume of a discussion of professional public about the independence and autonomy of judiciary. The thesis is sealed with the author’s opinion on possible solutions in the field of the autonomy of the judiciary.
