Legislation on personal income tax

Abstract:

The aim of the final paper is to create a comprehensive view and provide a basic orientation on the taxation of individuals. The paper is divided into free chapters. The first chapter of paper deals with the theoretical background applied in taxation of individuals, international taxation, terminology and other information that are derived from scientific literature oriented at the tax. The next part pays attention to the analysis of Act on income tax and its comparison with previous rules. Considering to the range of issue it is oriented on the most basic questions of substantive legislation, types of taxable income, the method of finding tax base, tax expenditures and other tax aspects. At the end of the second part is partly procedural legislation. The object of the third chapter is to show the practical aspects of taxation in economic dimension. The attention is paid to legal opportunities to reducing of tax base, so reducing a tax liability by instrument as a non taxable minimum income, the selection of method of taxation and others. The result of this paper is to show the impact of knowledge on tax legislation and how we can use them by reducing the tax. Part of the last chapters are practical examples for comparison.

Abstract:

Cieľom bakalárskej práce je vytvorenie uceleného pohľadu a základnej orientácie v zdaňovaní príjmov fyzických osôb. Práca je rozdelená do troch kapitol. Prvá časť bakalárskej práce sa zaoberá teoretickým pozadím zdaňovania fyzických osôb, medzinárodným zdaňovaním, terminológiou a inými informáciami čerpanými z odbornej literatúry zameranej na problematiku daní. Ďalšia časť je venovaná analýze platného zákona o dani z príjmov a jej porovnaním s predchádzajúcou úpravou. Vzhľadom na rozsiahlosť problematiky je zameraná na najzákladnejšie teoretické otázky hmotnoprávnej úpravy priamych daní, rozdelenie príjmov, spôsob zistenia základu dane, daňové výdavky, platenie a vyberanie daní. Záver každej z tém je venovaný zmenám v daňovej legislatíve, ktoré priniesla posledná novela a dôsledkom týchto zmien na fyzické osoby. Predmetom tretej kapitoly je praktická stránka zdaňovania v ekonomickom rozmere. Pozornosť je venovaná právnym možnostiam zníženia daňového základu, teda zníženiu daňovej povinnosti pomocou nezdaniteľných častí, výberom metódy zdaňovania a i. Výsledkom práce je ukázať vplyv znalostí zdaňovania a ako ich môžeme použiť pri znížení dane. Súčasťou poslednej kapitoly sú praktické príklady pre porovnanie.
