The Right to Access to Court for People with Physical and Sensory Impairment in the Czech Republic

Abstract:

Disertační práce se zabývá právem na přístup k soudu a spravedlnosti pro osoby s pohybovým a smyslovým postižením v České republice. Věnuje se legislativnímu rámci, soft law i judikatuře na národní, evropské i mezinárodní úrovni. Dále analyzuje jednotlivé povinnosti plynoucí smluvním stranám z článku 13 Úmluvy o právech osob se zdravotním postižením – Přístup ke spravedlnosti. Předložený text uvádí také příklady z judikatury popisující překážky, kterým mohou čelit lidé s tímto typem postižením v soudním řízení. Práce také rozebírá aktuální situaci v České republice v této oblasti. Její součástí jsou i výsledky dvou vlastních výzkumů – první z nich bylo dotazníkové šetření týkající se přístupnosti soudních budov a soudních řízení, druhý výzkum proběhl formou rozhovorů s lidmi s pohybovým nebo smyslovým postižením, kteří byli účastníky soudního řízení. Na závěr jsou prezentovány návrhy ke zlepšení stavu v České republice.

Abstract:

The dissertation deals with the right of access to court and justice for persons with physical and sensory disabilities in the Czech Republic. It focuses on the legislative framework, soft law and case law at national, European and international level. It also analyses the individual obligations of the State Parties under Article 13 of the Convention on the Rights of Persons with Disabilities - Access to justice. The presented text also provides examples from case law describing the obstacles that people with this type of disability may face in court proceedings. The dissertation also discusses the current situation in the Czech Republic in this area. It also includes the results of two own research - the first one was a questionnaire survey on the accessibility of court buildings and court proceedings, the second research was conducted in the form of interviews with people with physical or sensory disabilities who were participants in court proceedings. Finally, suggestions for improving the situation in the Czech Republic are presented.
