Invalidity of a Bill of Exchange in the Current Case Law

Abstract:

Tato diplomová práce se zaměřuje na identifikaci problémů směnečných listin, které mají vliv na neplatnost směnky v aktuální rozhodovací praxi a také na postoj jednotlivých soudů k těmto sporným oblastem. Jsou zde zejména prostřednictvím jednotlivých náležitostí směnky cizí, uvedeny sporné varianty zápisu směnečných doložek, které mohou vést k neplatnosti směnečné listiny jako celku. Věnován je prostor sporným otázkám, a to např. otázce směnky lokalizované k jejímu majiteli, grafické podoby směnky nebo splatnosti směnky s podrobnějšími časovými údaji. Není pominuta ani oblast interpretace směnky a otázka směnečné přísnosti. Některé náležitosti směnečné listiny jsou v rozhodovací praxi ustálené, jiné se setkávají s nejasným výkladem. Právě tento výklad je hlavním tématem této práce.

Abstract:

This diploma thesis focuses on identifying of problems of note deeds, which shall influence nullity of notes, in the current decision-making of courts and it also aims to identify attitude of particular courts to these contentious areas of law. Mainly through the individual elements of a bill of exchange are described disputable types of clauses in notes which can have a consequence in nullity of a note deed as a whole. The thesis also deals with such disputable questions, such as a note localized to its owner, graphic appearance of a note deed or maturity of a note bearing detailed time specification. It has also not been omitted the area of interpretation of a note and question of note´s rigidity. Some elements of note deeds are steady in the decision making of courts on the other hand an interpretation of some other is not clear. It is the unclear interpretation of some elements of note deeds which is subject matter of this diploma thesis.
