Recovery of Receivables Arising from the Abuse of the System of Noninsurance Social Benefits in the Czech Republic

Abstract:

Diplomová práce se zabývá úspěšností vymáhání pohledávek, které vznikly neoprávněnou výplatou nepojistných sociálních dávek. V teoretické části práce jsou stručně popsány samotné nepojistné sociální dávky, základní důvody vzniku přeplatků na těchto dávkách a způsoby jejich vymáhání prostřednictvím pracovníků Úřadu práce ČR. V navazující části práce je analyzován objem pohledávek vzniklých na jednotlivých dávkách za roky 2016 až 2020, počet uhrazených pohledávek, počet pohledávek, které mohou dlužníci stále ještě do konce doby splatnosti dobrovolně uhradit nebo mohou být do konce prekluzivní lhůty vymoženy. Dále je zhodnoceno, kolik pohledávek bylo vypořádáno jiným způsobem, a to předáním k vymáhání celnímu úřadu, odpisem pro nedobytnost nebo zánikem práva (prekluzí). V závěrečné části jsou navržena možná řešení vedoucí k případnému snížení počtu zneužívání dávek i návrhy vedoucí ke zvýšení úspěšnosti úhrady vzniklých pohledávek.

Abstract:

The diploma thesis deals with the success of debt collection, which arose from the unauthorized payment of non-insurance social benefits. The theoretical part of the thesis briefly describes the non-insurance social benefits themselves, the basic reasons for the overpayment of these benefits and the methods of their recovery through the staff of the Labor Office of the Czech Republic. The following part analyses the volume of receivables arising from individual benefits for the years 2016 to 2020, the number of paid receivables, the number of receivables that debtors can still voluntarily pay by the end of the maturity period or can be recovered by the end of the preclusive period. It also assesses how many receivables have been settled in another way, namely by handing them over to the customs office for recovery, write-off for irrecoverability or expiry of the right (expires). The final part proposes possible solutions leading to a possible reduction in the number of abuse of benefits and proposals leading to an increase in the success of payment of receivables.
