Abstract:

Předkládaná práce nabízí ucelený pohled na exekuční postih společného jmění manželů (dále jen "SJM"). V úvodních kapitolách nabízí exkurs do historického vývoje úpravy majetkového společenství manželů a zevrubně se věnuje účinné právní úpravě SJM. Samostatně pojednává o obsahu SJM, jeho modifikacích a evidencích, v nichž je možné takové úpravy dohledat. Čtenáři je dále objasněn dualismus panující na poli exekucí, pojem a funkce exekučního titulu a nastíněny způsoby provedení exekuce soudním exekutorem. Samostatná kapitola je pak věnována roli a procesnímu postavení manžela povinného a to i v situaci po zániku manželství. Závěr práce je věnován ochraně práv třetích osob, dluhům, které je možné uspokojit ze SJM či z výhradního majetku nedlužného manžela a ochraně takového manžela v probíhajícím exekučním řízení.

Abstract:

The presented work offers a comprehensive view of the distraint penalty of the joint property of the spouses (hereinafter referred to as "JPS"). The introductory chapters give an insight into the historical development of the property law of the spouses and deals in detail with the effective legal regulation of the JPS. It separately discusses the content of the JPS, its modifications and records, in which such modifications can be traced. The reader is further explained the dualism prevailing in the field of distraint, the concept and function of the writ of execution and outlines the methods of distraints by a bailiff. A separate chapter is then devoted to the role and procedural position of the liable spouse, as well as in the situation after the dissolution of the marriage. The conclusion of the thesis is devoted to the protection of the rights of third parties, debts that can be satisfied from the JPS or from the exclusive property of the non-debtor's spouse and the protection of such a spouse in the ongoing execution proceedings.
