Licence agreements in relations with an international element

Abstract:

Tato práce se věnuje problematice licenčních smluv k autorským dílům ve vztazích s mezinárodním prvkem. Tato otázka je zkoumána z pohledu evropského práva a v případě použití národní úpravy je analýza provedena dle českého práva. V obecné, teoretické části je rozebírána otázka autorského díla a licenční smlouvy dle českého práva. Dále se práce věnuje specifikům autorských práv v mezinárodním kontextu. Ve zvláštní části se práce věnuje otázce určení příslušného sudiště při sporech vznikajících z licenčních smluv a následnému určení rozhodného práva v případě absence jeho volby. Druhý díl zvláštní části je věnován určení sudiště při autorskoprávních deliktech a souvisejícímu určení rozhodného práva. Práce se zaměřuje zejména na užití autorského díla online na internetu.

Abstract:

The diploma thesis deals with issue of licences to copyright in relations with an international element. This question is researched from the perspective of European law and if national law is applied, the analysis is carried out under Czech law. In the general, theoretical part is discussed issue of copyright and licence agreement under Czech law. The thesis also deals with the specifics of copyright in international context. In the specific part the thesis deals with determination of courts having jurisdiction in disputes arising from the licence agreements and the subsequent determination of the applicable law in the absence of choice of law. The second section of the special part is focused on determination of courts having jurisdiction in disputes arising from copyright infringements and related determination of the applicable law. The thesis focuses mainly on the use of copyright online on the Internet
