Permanent residence, its meaning and function in our life

Abstract:

Tématem práce je institut trvalého pobytu, jeho význam a funkce v našem životě. Trvalý pobyt je významný identifikační údaj, který nás doprovází od narození a každý občan České republiky jej musí mít na nějaké adrese evidovaný. Pojem je definován zákonem o evidenci obyvatel. Evidenci obyvatel, tedy i trvalého pobytu vedou ohlašovny obcí, které údaje zapisují do celostátního Agendového informačního systému evidence obyvatel (AISEO). Práce se zabývá činností ohlašovny a situacemi, kdy je možné údaj trvalého pobytu změnit nebo ukončit, případně kdy může být zrušen ve správním řízení. Poslední teoretickou částí je výčet některých práv a povinností občanů, které se s místem trvalého pobytu pojí napříč celým právním systémem České republiky. Praktická část práce je zaměřena na domovské právo, možnost jeho obnovení a užití tohoto práva jako pomoci v otázce řešení bezdomovectví.

Abstract:

The topic of the work is the institute of permanent residence, its importance and its function in our lives. Permanent residence is used as an important identification data that accompanies us from birth. Every citizen of the Czech Republic must have permanent residence registered at some address. The term is defined by the Act on Population Registration. The records of the population, i.e. also the permanent residence, are reported by the reporting office of the municipalities, which also enter the data into the nationwide Agenda Information System of the Population Register (AISPOR). The essay looks into the activities of the reporting office and into situations, where it is possible to change or terminate the permanent residence data, or when it can be canceled in administrative proceedings. The last theoretical part is a list of some rights and obligations of citizens, which are associated with the place of permanent residence across the entire legal system of the Czech Republic. The practical part of the essay is focused on home law, the possibility of its renewal and the use of this law as a help in addressing homelessness.
