Consumer protection for the purchase of a used vehicle

Abstract:

Prodej ojetých vozidel je stále aktuální téma, a to zejména v právní oblasti. S rostoucím zájmem o ojetá vozidla narůstá také počet nekalých obchodních praktik podnikatelů. Právní úprava proto neustále zpřísňuje požadavky na podnikatele, aby tím byla zajištěna co největší míra spotřebitelské ochrany. Cílem diplomové práce je analyzovat hlavní právní rizika v případě koupě ojetého vozidla. Teoretická část práce nejprve objasňuje historickoprávní vývoj spotřebitelského práva a základní pojmosloví této problematiky. Hlavní stať diplomové práce se věnuje právnímu rozboru nejčastějších nekalých obchodních praktik při prodeji ojetých vozidel, kterých se prodávající (podnikatelé) dopouštějí vůči spotřebitelům. Poslední část práce charakterizuje vztah práva EU a české právní úpravy s ohledem na nekalé obchodní praktiky a spotřebitelskou ochranu. Obsahem praktické části jsou případy z praxe a rozhovor s bývalým provozovatelem autobazaru. V závěru praktické části jsou shrnuty základní poznatky, které mohou být spotřebiteli nápomocné v případě budoucí koupě ojetého vozu. S ohledem na teoretickou a praktickou část jsou poté vyhodnoceny nejčastější právní rizika ojetých vozidel.

Abstract:

The sale of used vehicles continues to be a hot topic, especially in the legal field. As interest in used vehicles grows, so does the number of unfair business practices by traders. The legislation is therefore constantly tightening the requirements for businesses to ensure the greatest possible level of consumer protection.The aim of the thesis is to analyse the main legal risks in the case of buying a used car. The theoretical part of the thesis first explains the historical and legal development of consumer law and the basic terminology of this issue. The main body of the thesis is devoted to the legal analysis of the most common unfair commercial practices in the sale of used vehicles, which sellers (entrepreneurs) commit against consumers. The last part of the thesis characterises the relationship between EU law and Czech legislation regarding unfair commercial practices and consumer protection.The practical part includes practical cases and an interview with a former car dealership operator. The practical part concludes with a summary of basic knowledge that may be helpful to consumers in the future purchase of a used vehicle. With regard to the theoretical and practical parts, the most common legal risks of used vehicles are then evaluated.
