Czech and Slovak Constitutional Court and their Influence on the form of the Political System

Abstract:

Předmětem této práce je vliv ústavních soudů České a Slovenské republiky na podobu volebního systému pro volby do Národní rady Slovenské Republiky a Poslanecké sněmovny Parlamentu České republiky. První část práce tvoří teoretický úvod, který se zabývá jak obecně ústavním soudnictvím, tak volbami a volebním systémem. Další část pak tvoří popis a zhodnocení postavení a pravomocí ústavních soudů a jejich vlivu na volební systém. Ústavní soudy obou zemí mají z hlediska právní úpravy v zásadě stejné postavení, český Ústavní soud si však svou judikaturou vydobyl mnohem významnější roli. Podobně je tomu tak i u volebního systému, kdy rozhodování slovenského Ústavního soud trpí především přílišným formalismem.

Abstract:

The object of the thesis is the influence of the Constitutional Courts in the Czech Republic and Slovakia on the electoral system for the elections to the National Council of the Slovak republic and the Chamber of Deputies of the Parliament of the Czech Republic. The first part of the thesis is the theoretical introduction, containing chapters about the constitutional judicature, elections and the electoral system. The following part of the thesis describes and evaluates the role and competences of the both constitutional courts and their influence on the electoral system. Both Constitutional Courts have the same role from the point of view of legal provisions, however, the Czech Constitutional court with its judicature has achieved a more significant position. The same applies to the voting system when the rulings of the Constitutional Court in Slovakia suffers from excessive formalism.
