Abstract:

Diplomová práce se zabývá právní úpravou ochrany národních parků na území ČR. Cílem práce je seznámit čtenáře s institutem národních parků jakožto našich nejdůležitějších zvláště chráněných území a zhodnotit účelnost a dostatečnost právní úpravy zajišťující jejich ochranu. V první části práce autor představí relevantní prameny právní úpravy, a to jak mezinárodní a unijní, tak tuzemské. Další část práce se věnuje rozboru a analýze institutu národního parku a jeho vývoji. Ve třetí části se práce zabývá institucionálním zajištěním ochrany národních parků a dílčích změn přijatých v rámci věcné novely nového stavebního zákona. Ve čtvrté části se práce zabývá analýzou samotných prostředků ochrany. V části páté a v závěru pak dochází k vyjádření autorových názorů a k návrhům de lege ferenda a ke zhodnocení účelnosti a dostatečnosti právní úpravy.

Abstract:

The thesis deals with the legal regulation of the protection of national parks in the territory of the Czech Republic. The aim of the thesis is to acquaint the reader with the institute of national parks as our most important special areas of conservation and to evaluate the effectiveness and sufficiency of the legal regulation ensuring their protection. In the first part of the thesis, the author presents relevant sources of legislation, both international and EU, as well as domestic. The next part of the thesis is devoted to the analysis of the institute of national park and its development. The third part of the thesis deals with the institutional provision of protection of national parks and partial changes adopted in the framework of the substantive amendment of the new Construction Act. The fourth part of the thesis deals with the analysis of the means of protection themselves. In the fifth part and in the conclusion, the author's views and de lege ferenda proposals are expressed and the effectiveness and sufficiency of the legislation is evaluated.
