Disertační práce zkoumá vztah imperativních norem práva státu, kde se koná rozhodčí řízení, a mezinárodního obchodního rozhodčího řízení. Konkrétně se zabýváme problematikou aplikace a zohledňování těchto imperativních norem ve fázi rozhodování sporu. Hledáme odpověď na otázku, zda mají tyto normy vliv na meritorní rozhodování o spor. Abstract:
The dissertation thesis deals with relationship between overriding mandatory rules of the seat of arbitration and international commercial arbitration. We focuse on the issue of application of those overriding mandatory rules in phase of deciding on the merits of the case.
