Labor law claims regarding job termination

Abstract:

The aim of this essay is to point at issues regarding exercising an employee’s claims when one´s job is terminated. The main idea is to focus on ensuring the claims in cases when the employer doesn’t fulfill his obligation as required by the law. We have been dealing with employee-employer relationship. The relationship leading to a contract of employment, concluding the contract of employment, and the termination of an employee´s contract. The whole problematic aspect of how to ensure claims after being dismissed from a job – pay, holiday compensation, business trip compensation, redundancy payment – is highly commonplace inasmuch as in many cases there are often counts of noncompliance from employers when it comes to meeting their obligations. More often than not the ignorance of the law on the employee side results in the employee´s inability to claim his rights and to gain the correct compensation from employer.

Abstract:

Cieľom tejto práce je poukázať na problematiku uplatnenia pracovnoprávnych nárokov zamestnanca pri skončení pracovného pomeru. Hlavná myšlienka je zameraná na vymožiteľnosť týchto nárokov, keď si zamestnávateľ neplní svoje povinnosti tak ako ukladá zákon. Poukázali sme na vzťah zamestnávateľa a zamestnanca - predzmluvné vzťahy, uzatvorenie pracovnej zmluvy, zánik pracovného pomeru. Problematika vymožiteľnosti nárokov pri skončení pracovného pomeru – mzda, náhrada dovolenky, náhrada za pracovnú cestu, odstupné – je veľmi aktuálna téma, nakoľko v mnohých prípadoch dochádza k nesplneniu si tejto povinností zo strany zamestnávateľa. Často nevedomosť – neznalosť zákonov na strane zamestnanca spôsobí, že zamestnanec si nevie uplatniť svoj nárok a domôcť sa plnenia zo strany zamestnávateľa.
