Witness testimonies: The relationship of memories and the subjective interpretation of victim's risk behavior

Abstract:

Cílem naší práce bylo zjistit, jak souvisí subjektivní interpretace rizikového chování ze strany oběti trestného činu se zapamatovanými obsahy uváděnými ve svědeckých výpovědích. Náš výzkumný soubor tvořilo 156 respondentů, rozdělených do dvou experimentálních skupin lišících se v přítomnosti a nepřítomnosti rizikového chování oběti. Na základě videonahrávky respondenti absolvovali tři svědecké výpovědi – první ve formě rozhovoru, druhou a třetí formou online formuláře. První výpověď proběhla 15 – 20 minut po zhlédnutí videa, druhá za 24 - 48 hodin a třetí za 3 týdny. Výsledky nám ukázaly, že svědkovo hodnocení rizika souvisí se zapamatovanými obsahy. V případě obou typů obětí bylo shledáno podcenění rizika, u oběti se známkami rizikového chování pro chování samotné, v případě oběti bez známek rizikového chování pro vystavení se nebezpečnému místu. Přepadení oběti se znaky rizikového chování bylo vnímáno jako vyprovokované, u oběti bez známek rizikového chování bylo chybně uváděno použití zbraně, kterou pachatel neměl. Dále z našich výsledků vyplývá, že svědkova interpretace rizikového chování je v čase konstantní.

Abstract:

The aim of this study was to find out how is related the subjective interpretation of the risk behavior by the victims of the crime with the memories content mentioned in the testimonies. The sample included 156 respondents, divided into two experimental groups, distinguished in the presence and absence of the risk behavior of the victim. On the basis of the video, the respondents completedthree testimonies - the first in the form of an interview, the second and third on-line forms. The first testimony was 15-20 minutes after the video was viewed, the second in 24-48 hours, and the third in 3 weeks. The results have shown that the risk assessment is related to the memorized content. For both types of victims, underestimation of risk was found, in the case of victims with signs of risk behavior for behavior itself, in the case of a victim without a sign of risk behavior for exposure to a dangerous site. The attack of the victims with the signs of risk behavior proved to be provoked, and the victims who did not show the risk behavior were misinterpreting the use of a weapon of perpetrator. Furthermore, our results show that the interpretation of the risk behavior is constant over time.
