Tenant Protection in the Termination of Lease - Comparison of the Legislation in the Czech Republic and Latvia

Abstract:

Diplomová práce se zabývá srovnáním české a lotyšské právní úpravy výpovědi z nájmu se zaměřením na ochranu nájemce, který představuje v nájemních vztazích slabší smluvní stranu. Tato práce je rozčleněna na šest částí. První dvě kapitoly se věnují obecnému vymezení nájmu a pramenů práva upravujícího nájem. Třetí část se zabývá výpovědí z nájmu bytu nejen ze strany pronajímatele, ale také ze strany nájemce. Jsou zde rozebrány náležitosti výpovědi a také jednotlivé výpovědní důvody. Čtvrtá kapitola je také zaměřena na výpověď z bytů upravených zvláštními ustanovením. Zejména jde o byty služební, zvláštního určení a také byty sociální. V páté části je rozebrán soudní přezkum oprávněnosti výpovědi z nájmu. Poslední, šestá kapitola, představuje exkurz do dalších institutů sloužících k ochraně nájemce.

Abstract:

The thesis deals with a comparison of Czech and Latvian legislation termination of the lease, with a focus on protection of the tenant, who represents the weaker party in lease relations. This work is divided into six parts. The first two chapters contain a general definition of rent and sources of law regulating the rent. The third part deals with the termination of the lease of the apartment given not only by the landlord but by the tenant as well. There are analyzed notice requirements and also various reasons for termination. The fourth chapter is focused on the notice in case of rent of flats regulated by a special provision. Especially, it deals with flats for staff, special purpose flats and social flats. The fifth part analyzes the judicial review of the termination of the lease. The last, sixth chapter presents an excursion into other institutes created with aim to protect tenants.
