Principles as the Source of Private Law

Abstract:

Tato práce si klade za cíl zmapovat vývoj právních zásad českého soukromého práva jako pramene práva od roku 1991 a zhodnotit, jak se tento vývoj promítl do zákona č. 89/2012 Sb., občanský zákoník. Nejprve bude v textu práce pojednáno o pramenech práva a právních zásadách a jejich rolích v rozdílných právních kulturách. Následně bude pozornost zaměřena na evropský kontext právních zásad, z čehož budeme moci vyvodit určité ovlivnění domácího právního vývoje. Jádro diplomové práce bude zaměřeno na funkci zásad soukromého práva jako pramene práva v současném občanském zákoníku a dřívějším občanském zákoníku. Následně se bude autorka věnovat konstitucionalizaci soukromého práva, která dané téma jistě také ovlivňuje. Práce by pak měla ve výsledku ukázat, zda a do jaké míry figurují zásady jako pramen práva v českém soukromém právu v korektivním či čistě normativním pojetí.

Abstract:

The purpose of this thesis is to explore the evolution of legal principles in the Czech private law as a source of law since 1991 and evaluate how this evolution has been reflected into the Civil Code no. 89/2012 Coll. At the beginning, a discussion of sources of law and legal principles and their roles in different legal cultures will be held. Afterwards, the attention will be focused to the European context of legal principles from which we will be able to deduce its certain influence on the evolution of domestic law. The essence of this thesis will be focused on a function of principles of private law as a source of law in the present Civil Code and the former Civil Code. Afterwards, the author will be focusing on constitutionalisation of the private law that certainly has some influence on the given topic. In the end, findings of this thesis will present whether and how the principles as a source of Czech private law function in the corrective or purely normative conception.
