Contractual regulation of relations between professional footballers and their clubs in the context of labour law

Abstract:

The aim of this diploma thesis is to analyze the issue of contractual relationships arising between professional football players and their clubs and the subsequent analysis of the content of these legal relationships in the Czech law in view of its (in)compatibility with labor law standards. The introductory part of the thesis contains the definition of basic concepts and institutions, while it should also serve as a setting of the topic of this diploma thesis in a social and legal context. The next part deals with the view of the athlete as a self-employed person and then from a labor-law point of view. Subsequently, the author deals with setting the mutual rights and obligations of the parties, which he analyzes and evaluates their compliance with labor law standards. In case of difference between the factual situation and the legal regulation of labor law, the author continuously proposes possible solutions to these situations, whereby the last part of the thesis generally speaks about de lege ferenda solutions.

Abstract:

Cieľom tejto diplomovej práce je rozobrať problematiku zmluvných vzťahov vznikajúcich medzi profesionálnymi futbalistami a ich klubmi za účelom výkonu športovej činnosti samotného hráča pre klub a následná analýza samotného obsahu týchto právnych vzťahov v českom právnom prostredí vzhľadom na jeho (ne)kompatibilitu s pracovneprávnymi normami. Úvodná časť práce obsahuje vymedzenie základných pojmov a inštitútov, pričom má slúžiť zároveň ako zasadenie témy tejto diplomovej práce do spoločenského a právneho kontextu. V ďalšej časti je rozobraná povaha činnosti profesionálneho futbalistu z hľadiska jej ponímania ako závislej práce alebo inej formy zárobkovej činnosti. Následne sa autor zaoberá nastavením vzájomných práv a povinností strán, ktoré dôkladne analyzuje a vyhodnotí ich súlad s normami pracovného práva. V prípade nesúladu faktického stavu s právnou úpravou pracovného práva autor v diplomovej práci priebežne navrhuje možné riešenia týchto situácií, pričom celkovým úvahám de lege ferenda sa venuje posledná časť práce.
