Execution of a ruling through sale of domain name

Abstract:

Cílem této bakalářské práce je dospět k závěru, zda lze de lege lata uspokojit peněžitou pohledávku věřitele postižením práva dlužníka k doménovému jménu. V teoretické části práce se zabýváme zejména pojmem doménové jméno a definujeme jeho právní povahu. V další části práce analyzujeme právní ustanovení občanského soudního řádu a exekučního řádu, definujeme vztah těchto dvou zákonů a podrobněji popisujeme postup, jakým může být právo k doménovému jménu postiženo. Zabýváme se též možností dlužníka bránit se tomuto postupu. V závěrečné části práce se zamýšlíme nad právními specifiky daňové a správní exekuce.

Abstract:

This bachelor thesis answers the question „Is it possible and legal according to Czech law to execute a ruling through sale of domain name?“ In theoretical part of thesis we deal with the legal nature of domain name. In the next part of thesis we analyze legal provisions, law n. 99/1963 Sb. and n. 120/2001 Sb. and we define relationship between these two provisions. We describe the process of sale of domain name and we explain the ways how to prevent the possibility of execution. In the last part of thesis we think about the specifics of tax execution and administrative execution.
