Use of Chemical Weapons: Syria Case Study

Abstract:

Diplomová práce se zabývá problematikou používání chemických zbraní. K otázkám v ní řešeným se staví prizmatem mezinárodního humanitárního práva. Dle metodologie případové studie se dělí na dvě části, teoretickou a aplikovanou. V první části se zabývá mezinárodně právní úpravou používání chemických zbraní, přičemž věnuje zvláštní pozornost Úmluvě o zákazu chemických zbraní z roku 1933. Poznatky aplikuje ve druhé části na události v Sýrii, kriticky hodnotí jejich důsledky a analyzuje možnosti reakce mezinárodního společenství, které by byly v souladu s mezinárodním právem.

Abstract:

This thesis deals with the issue of chemical weapons usage. The whole dilemma is viewed from the perspective of the International Humanitarian Law. According to the methodology of a case study the work is divided into two parts, theoretical and applied. The first part focuses on the legality of chemical weapons usage with special emphasis on the Chemical Weapons Convention from 1993. Its findings are applied in the second part to the events which took place in Syria. Furthermore the consequences derived thereof are critically assessed and possible ways of international community reactions compliant with the International Law are analyzed.
