Free Will and Responsibility

Abstract:

Tato diplomová práce se zabývá vztahem svobodné vůle a odpovědnosti. V práci jsou nejprve představeny základní problémy, které jsou se svobodou vůle spjaty přednostně problém determinismu i indeterminismu, jakož i základní pozice zastávané obhájci či odpůrci svobodné vůle, totiž kompatibilismus, libertarianismus a hard determinismus. Prostor je dále věnován pojmu odpovědnosti, a to jak právnímu, tak morálnímu, a jeho vztahu ke svobodné vůli a trestání. Stěžejní teorie trestání, retributivismus a konsekvencialismus, a podmínky jejich ospravedlnění jsou podrobněji rozebrány v poslední části práce včetně souvislostí s odpovědností a svobodou volby. Důsledky, které z těchto zjištění pro právo vyplývají, jsou popsány v závěru. Tím je myšlena především nezávislost lidského vnímání svobody vůle a odpovědnosti na determinismu i indeterminismu. Odpovědnost a s tím spojené ospravedlnění trestu potom v konečném důsledku nezáleží ani tak na skutečně existující svobodné vůli jako na našem pocitu kontroly vlastního jednání.

Abstract:

This thesis deals with relation between free will and responsibility. In the beggining underlying problems of free will like truth of determinism or indeterminism are introduced as well as main positions hold by proponents and dissenters of free will like compatibilism, libertarianism and hard determinism. Further text is devoted to conception of moral and legal responsibility and its relation to free will and punishment. Crucial theories of punishment both retributivism and consequentialism and conditions for their justification including relation to responsibility and freedom of choice are discussed in final part of thesis. In conclusion there is description of implications for the law which resulted from text. It means primarily independence of human perception of free will and responsibility on both determinism and indeterminism. Responsibility and associated justification of punishment ultimately depend not on truly existing free will but rather on sense of control our own action.
