Analysis of the Institute of Personal Bankruptcy according to the Insolvency Act

Abstract:

V rigorózní práci na téma Analýza institutu oddlužení dle insolvenčního zákona (Analysis of the Institute of Personal Bankruptcy according to the Insolvency Act) je analyzována právní úprava oddlužení, která je obsažena v insolvenčním zákoně. Vzhledem ke skutečnosti, že právní úprava oddlužení je postupně „doplňována“ judikaturou insolvenčních soudů, je v této práci obsažena i kompilace judikatury k jednotlivým fázím insolvenčního řízení. Při analýze oddlužení jsou jednotlivé fáze oddlužení podrobeny kritickému pohledu s návrhy de lege ferenda, které by mohly v budoucnu být pro právní úpravu oddlužení přínosem.

Abstract:

In the doctoral thesis Analysis of the Institute of Personal Bankruptcy according to the Insolvency Act the legislation of the personal bankruptcy which is included in the Insolvency Act is analysed. Due to the fact that the legislation of the personal bankruptcy has been gradually “supplemented“ by the judicature of the insolvency courts there is even the compilation of the judicature to the single phases of the incolvency proceedings at this work. The single phases of the personal bankruptcy are being put through the critical view with the proposal of de lege ferenda by the analysis of the personal benkruptcy which could be asset for the legislation of the personal bankruptcy in future.
