Abstract:

Cílem diplomové práce „Opatření obecné povahy jako forma činnosti veřejné správy v územním plánování“ je definovat opatření obecné povahy a popsat jednotlivé formy jeho použití v územním plánování. Práce se rovněž zabývá soudním přezkumem včetně novely (zák. č. 303/2011 Sb.) soudního řádu správního. Kratší kapitoly jsou věnovány veřejné správě, použití opatření obecné povahy v dalších oblastech práva a politice územního rozvoje. Problematika je ilustrována judikaturou Nejvyššího správního soudu a Ústavního soudu.

Abstract:

The aim of the submitted thesis: “The Measure of a General Nature as a Form of Public Administrations Activity in the Field of Land Planning” is to define the measure of a general nature and describe particular forms of its use in the land planning. The thesis also deals with judicial review including the amendment (act Nr. 303/2011 Coll.) of the Code of Administrative Justice. Shorter chapters are dedicated to public administration, use of the measure of a general nature in other law areas and spatial development policy. Problems are illustrated by the the judicature of the Supreme Administration Court and Constitutional Court.
