The Limits of the State Interventions into Parental Rights in the Light of Human Rights Case Law

Abstract:

Tato diplomová práce se zabývá mezemi zásahů státu do rodičovských práv ve světle lidskoprávní judikatury. Práce se zaměřuje na tři konkrétní případové situace, které popisují zásahy státu do rodičovských práv. Jde o odebírání dětí z rodin, povinné očkování a sexuální výchovu na základních školách. Účelem zkoumání je určit, zda v těchto případech existuje legitimní důvod chránící zájmy dítěte, který ospravedlní zásahy státu do rodičovských práv, či nikoli. V úvodu práce jsou definovány pojmy rodina, zájem dítěte a rodičovská práva. Dále práce uvádí tři případové studie. Konkrétní okolnosti každého případu jsou posuzovány z pohledu dostupné judikatury (zejména nejvyšších soudů, Ústavního soudu a Evropského soudu pro lidská práva), pozitivního práva a odborné literatury. Na závěr jsou celkově zhodnoceny zásahy státu do rodičovských práv a jsou učiněna odpovídající doporučení.

Abstract:

This final thesis deals with the limits of state interventions into parental rights in the light of human rights case law. This thesis focuses on three specific case studies which describe situations of state interventions into parental rights. These are: removing children from families, mandatory vaccinations and sex education at primary schools. The purpose of the research is to determine whether there is a legitimate reason protecting best interests of the child which would justify state interventions into parental rights in these cases or not. At the beginning of the thesis, concepts of the family, best interests of the child and parental rights are defined. Further, the thesis introduces three case studies. Specific circumstances of each case are examined especially from the perspective of available case law (particularly that of supreme courts, the Constitutional Court and the ECHR), legislation and legal literature. Finally, state interventions into parental rights are evaluated in general and appropriate recommendations are emphasised.
