Abstract:

Cílem bakalářské práce je popsat, jakým způsobem lze v souladu se zákoníkem práce skončit pracovní poměr jak ze strany zaměstnavatele, tak ze strany zaměstnance, a analyzovat míru flexibility těchto způsobů. Na příkladech se pak hledají obvyklé důvody okamžitého skončení pracovního poměru, které řeší soudy, a porovnává přístup soudů. První část se zabývá právním rámcem, v němž probíhá skončení pracovního poměru. Druhá část analyzuje a porovnává obvyklé případy skončení pracovního poměru objevující se v judikatuře. Třetí část zkoumá flexibilitu způsobů skončení pracovního poměru.

Abstract:

The aim of the bachelor's thesis is to describe how, in accordance with the labour code, an employment relationship can be terminated by both the employer and the employee, and to analyse the degree of flexibility in these ways. Examples then look for the usual reasons for the immediate termination of an employment relationship, which are dealt with by the courts, and compare the approach of the courts. The first part deals with the legal framework within which the termination of the employment relationship takes place. The second part analyses and compares the usual cases of termination stemming from case law. The third part examines the flexibility of termination procedures.
