Judicial Power in the Political System of the Czech Republic. Case study of judicialization of politics.

Abstract:

V rámci mé diplomové práce se zaměřuji na proces, který je typický pro většinu demokratických zemí a nese název judicializace politiky. Obecně lze judicializaci politiky definovat jako proces zvyšující se role soudné moci v rozhodovacích procesech. Práce se zaměřuje na judicializaci politiky v České republice od jejího vzniku až do dnešní doby. Cílem práce je se podívat na přítomnost judicializace politiky v českých podmínkách a představit ústavní přezkumy, ve kterých je proces možné spatřit. V našich podmínkách je hlavním orgánem soudní moci Ústavní soud České republiky, popřípadě Nejvyšší správní soud. Jedná se o případy, ve kterých se dříve soud neangažoval a postupem času nastal opak. Ve výsledku dojde nejen k obecné charakteristice pojmu judicializace politiky, ale následně budu analyzovat vybrané ústavní nálezy, kde by se měla judicializace politiky ukázat. Jak moc se soudy zapojují do rozhodovacích procesů v oblasti politického prostoru.

Abstract:

In my diploma thesis I am focusing on the process that is typical for the majority of democratic countries - the judicialization of politics. Generally, the judicialization of politics can be defined as the process the increasing role of judiciary in decision-making cases. The thesis is concentrating on judicialization of politics in the Czech Republic from its founding to nowadays. The thesis is aiming to look at the presence of judicialization of politics in Czech conditions and introduce constitutional reviews, in which we can see the process itself. In our conditions, the main organ of the judiciary power is Constitutional Court of the Czech Republic, alternatively Higher Administrative Court. It is concerning the cases, in which the court didn't get involved and in the course of time it changed Eventually, the thesis will deliver not only general characteristic of the concept of judicialization of politics, but also it will analyze selected constitutional findings that demonstrate judicialization of politics. The issue is how much the courts get involved in decision-making process in political space.
