Position of the bailiff in civil proceedings and its comparison with other EU states

Abstract:

Přijetí zákona č. 120/2001 Sb., o soudních exekutorech a exekuční činnosti (exekuční řád) a o změně dalších zákonů, způsobilo tzv. dvojkolejnost, která spočívá ve skutečnosti, že nucený výkon exekuční činnosti již není výlučně v pravomoci soudu, ale část jeho pravomocí byla převedena na nově vzniklý institut soudního exekutora. Na soudního exekutora, který je v postavení podnikatele, přešla část mocenských pravomocí a exekučním řádem mu bylo stanoveno, jakým způsobem má svou činnost vykonávat. Při výkonu exekuční činnosti pak vystupuje v postavení úřední osoby v kombinaci s rizikem, které přináší podnikání. Pro diplomovou práci jsem zvolila název Postavení soudního exekutora v civilním řízení a komparace s ostatními státy EU. Na základě dosavadních znalostí v kombinaci se studiem legislativy, odborné literatury, stavovských předpisů, judikatury, kvalifikačních prací s obdobnou tématikou a odborných článků práce porovnává a popisuje postavení soudního exekutora na území České republiky s činností exekutorů v zahraničí. První část práce se v krátkosti věnuje historickému vývoji exekučního řízení od dob římského práva až po období první republiky. Třetí a čtvrtá kapitola pojednává o postavení soudního exekutora, jakožto podnikatele, možnostech jeho dalších činnosti a rozebírá průběh exekučního řízení, přes způsoby provedení exekuce, až po její skončení. V druhé polovině diplomová práce porovnává rozvrh a přidělování práce v obdobných profesích, jako jsou soudci, notáři nebo insolvenční správci, a to včetně porovnání nákladů řízení a jejich odměn. Poté práce srovnává úhrady nákladů exekučního řízení v České republice oproti úhradám v Německu, Francii a na Slovensku. Závěr práce se věnuje zavedení místní příslušnosti soudních exekutorů, popisu slovenského modelu teritoriality a uvádí důvody pro i proti jejímu zavedení. Cílem poslední části je objasnit, z jakých důvodů je nezbytná změna současné legislativy a potřeba zavedení čisté krajské teritoriality v kombinaci s principem jeden dlužník - jeden exekutor.

Abstract:

The adoption of Act No. 120/2001 Coll., On Bailiffs and Execution Activities (Execution Rules) and on Amendments to Other Acts, caused the so-called double-track. It consists of the fact that the forced performance of execution activities is no longer exclusively within the jurisdiction of the court, but part of its powers were transferred to the newly established institute of bailiff. Part of the powers has been transferred to the bailiff, who is in the position of an entrepreneur. The Rules of Execution have determined him how to perform his activities. He acts as an official in combination with the business risk connected with the performance of the execution activities. For my diploma thesis I have chosen the title "The position of bailiff in civil proceedings in comparison with other EU countries." The thesis compares and describes the position of a bailiff in the Czech Republic with the activities of executors abroad based on the previous knowledge and the co study of legislation, professional literature, professional regulations, case law, qualification theses with similar topics and professional articles. The first part of the thesis briefly describes the historical development of execution proceedings from the time of Roman law to the period of the First Republic. The third and fourth chapters deal with the position of the bailiff as an entrepreneur, the possibilities of his other activities. It discusses also the course of execution proceedings, through the methods of execution, until its completion. The thesis compares the schedule and allocation of work in similar professions, such as judges, notaries or insolvency administrators, including a comparison of the costs of proceedings and their remuneration in its second half. Then this thesis also compares the reimbursement of costs of execution proceedings in the Czech Republic compared to the reimbursement of the cost in Germany, France and Slovakia. The conclusion of this thesis deals with the introduction of local jurisdiction of bailiffs, a description of the Slovak model of territoriality and gives reasons for and against its introduction. The aim of the last part is to clarify the reasons why it is necessary to change the current legislation and the need to introduce pure regional territoriality in combination with the principle of one debtor - one executor.
