Abstract:

OBECNÝ KOMENTÁŘ K RIGORÓZNÍ PRÁCI Mezinárodní právo civilního letectví a kosmické právo patří mezi nejmladší právní odvětví, což je do značné míry způsobeno specifickým a především technickým charakterem této lidské činnosti. Ponecháme – li stranou komerční problematiku civilního letectví, představuje vývoj právní úpravy vzdušného prostoru velice zajímavou kapitolu v rámci mezinárodního práva veřejného. Základem mé rigorózní práce je fakt, že integrální součástí každého státního území je i vzdušný prostor. Každý stát má úplnou a výlučnou svrchovanost nad vzdušným prostorem, rozprostírajícím se nad suchozemským územím, vnitrostátními vodami a pobřežním mořem. Z hlediska výškového vymezení vzdušného prostoru lze logicky předpokládat, že se jedná o oblast atmosféry sahající do výše, kde začíná kosmický prostor. Technicko – provozní specifika, která ovlivňují mezinárodní právo civilního letectví se však již projevují v okamžiku, kdy má být vzdušný prostor státu jasně výškově vymezen. Otázka právní úpravy vzdušného prostoru byla položena na počátku 20. století v souvislosti s rozvojem letectví, neboť do té doby normy mezinárodního práva tuto problematiku neupravovaly. Lze tvrdit, že se za dobu existence pramenů mezinárodního práva civilního letectví (téměř devadesát let) nedošlo k přímé a přijatelné definici, jež by stanovila, kde začíná a kde končí vzdušný prostor, ve kterém může stát uplatňovat svoji úplnou a výlučnou suverenitu. Do druhého poloviny minulého století se předpokládalo, že suverénní práva státu na vzdušný prostor na jeho územím se rozprostírají do neohraničené výše (usque ad coelum). Posun kupředu přinesl až intenzivní vývoj kosmického výzkumu (a s tím spojeného kosmického práva), který s sebou přinesl nutnost definovat kosmický prostor, kde již jednotlivé státy svoje práva spojená s úplnou a výlučnou suverenitou ve vzdušném prostoru vykonávat nemohou. Proto se, zejména s poukazem na Deklaraci Valného shromáždění OSN z roku 1963, ujala koncepce, podle níž se státní suverenita vztahuje pouze na vzdušný prostor, nikoliv však už na kosmický prostor, který podléhá zvláštnímu režimu. Podle převažujícího názoru vede hranice mezi vzdušným a kosmickým prostorem v nejnižší výšce oběžné dráhy (tzv. perigeum), na niž byly vyneseny umělé družice Země. Tento názor je prezentován v článku IV. Smlouvy o zásadách činnosti států při výzkumu a využívání kosmického prostoru včetně Měsíce a jiných nebeských těles z roku 1967 (Kosmická smlouva). Podle ustanovení tohoto článku, se umístění objektu nesoucího jaderné zbraně nebo jakékoli jiné druhy zbraní hromadného ničení, na oběžnou dráhu kolem Země, posuzuje jako umístění takových zbraní v kosmickém prostoru. O definici kosmického prostoru (a tím pádem i pod ním nacházejícího se vzdušného prostoru) se pokusilo i Sdružení pro mezinárodní právo, které v roce 1968 přijalo rezoluci, podle níž se za kosmický prostor považuje veškerý prostor nad a na úrovni nejnižšího perigea kterékoli umělé družice Země vypuštěné do 27. ledna 1967, tj. do dne, kdy byla otevřena k podpisu Kosmická smlouva. Vzhledem k tomu, že i nadále panovaly nejasnosti týkající se nejnižšího perigea vypracoval Sekretariát OSN dokument, který stanoví, že nejmenší výška, na níž je možno vypustit umělou družici bez nebezpečí, že shoří v atmosféře nebo spadne na Zemi, je 90 kilometrů. číná působit přitažlivost jiných nebeských těles. Tento názor je však často a oprávněně kritizován pro jeho extrémní rozšiřování oblasti státní suverenity, zejména pokud je brán v úvahu fakt, že zemská přitažlivost působí do výšky 260 000 km, kde začíná působit přitažlivost Slunce. Problematičnost takového vymezení vzdušného prostoru z hlediska právní úpravy je tedy více než zřejmá, nehledě na to, že takové extenzivní pojetí vzdušného prostoru a suverenity by znamenalo prakticky znemožnění jakéhokoliv kosmického výzkumu. Úkolem jednotlivých států, ale i vědy mezinárodního práva bylo vymezení právního režimu vzdušného prostoru. Bylo nutno stanovit, zda proniknutí letadel do vzdušného prostoru nad územím jiného státu bude posuzováno jako porušení suverenity tohoto státu, anebo zda vzdušný bude svobodně využíván bez jakéhokoli omezení. Jedním z cílů této rigorózní práce je zmapování historického vývoje právní úpravy vzdušného prostoru od počátků letectví až do současné podoby a přiblížení aktuální praxe při využívání vzdušného prostoru v rámci mezinárodního létání, včetně cílů a poslání Mezinárodní organizace pro civilní letectví ICAO. Vzhledem k mému profesionálnímu zaměření jsou také specifické oblasti právní úpravy vzdušného prostoru zkoumány z pohledu služeb řízení letového provozu. V tomto směru jsem proto analyzoval současnou úpravu mezinárodně – právní odpovědnosti států při zajišťování tohoto poslání a pozici poskytovatelů služeb řízení letového provozu. Z hlediska bezpečnosti vzdušného prostoru a v souvislosti s teroristickými útok z 11. září 2001 v New Yorku a Washingtonu bylo nezbytné začlenit do rigorózní práce i část pojednávající o mezinárodní úpravě potírání nezákonných činů v civilním letectví, protože s problematikou užívání vzdušného prostoru a jeho právní úpravou úzce souvisí. Účelem této části práce je analýza základních mezinárodních úmluv upravujících problematiku potírání protiprávních zásahů do civilní letecké dopravy a režim vzdušného prostoru při mimořádných situacích. Jednotlivé kapitoly rigorózní práce se samozřejmě primárně zabývají úpravou z hlediska práv a povinností států v mezinárodním civilním letectví, pro úplnost jsem však zařadil (tam, kde je to z logiky věci možné a žádoucí) i návaznost a úpravu vyplývající z českého právního řádu. S ohledem na mnohé provozní a technické aspekty ovlivňující právní úpravu mezinárodního civilního letectví a zejména problematiku poskytování služeb řízení letového provozu má předkládaná rigorózní práce především praktické zaměření. Tento fakt je i příčinou menšího zastoupení teorie práva v příslušných částech rigorózní práce.

Abstract:

The disparate development of the civil aviation law and its connection with technical progress has led to a situation where some fundamental issues of the international law, in particular the issue of legal treatment of the airspace, have not been resolved in a satisfactory way. A typical example in this area is the definition of airspace itself and thus definition of the sovereignty of the different countries. The result of this situation is the fact that one of the main sources of the international law in civil aviation is still customary law. The issues of defining airspace in terms of exercising state sovereignty and polemic with different theories form also the introduction of this rigorous thesis. As a conclusion, long acknowledged by most legal specialists and supported by the provision of the Treaty on principles regarding activities of the states in the Outer Space, on the Moon and the other planets (Cosmic Treaty 1967) the boundary of the airspace, where a state sovereignty can no longer be exercised, was set as the height of the first perigee of an artificial satellite, i.e., approximately 90 km. Chapter II. includes an analysis of the development of the international-law regulation of civil aviation and the legal treatment of airspace in the period between the two world wars, in particular the importance of the international Convention on International Civil Aviation signed in Chicago in 1944. This international convention is the fundamental and most important legal regulation of international civil aviation. In respect of the legal regulation of the airspace, the key definition is included in article 1 of the Chicago convention, stating: “Every state has complete and exclusive sovereignty over the airspace above its territory”. Chapter II also includes a description of the mission, structure and legislative activity of the International Civil Aviation Organization (ICAO). It is mainly the area of creating standards and recommendations. Chapter III addresses the issues of the legal treatment of airspace in the case of the individual states as well as the rights and obligations of the states in the airspace over the high sea and the Antarctica. Specific attention is also paid to the regulation of the use of airspace in the case of coastal waters of archipelago states and international channels and canals. The chapter also assesses the stay of an aircraft in the territory of a foreign state from the perspective of international law, including the requirements associated with the entry of an aircraft to a foreign airspace (so-called permitting principle). Chapter IV. of the rigorous thesis addresses the issue of responsibility of the states and providers of air navigation services from the perspective of international law. This area is not regulated in a satisfactory way, unlike the elaborated contractual arrangement in the case of the air carriers’ responsibility, so-called “Warsaw system”. This deficiency has shown specifically in the case of the midair collision over the Bodam Lake caused by the Swiss provider of air traffic control services in 2002. The possibility of delegating air navigation service in a country’s own airspace on another state brings along the need of a clear international-law regulation of this issue. With respect to the need to regulate the rights and obligations of states in their airspace as well as the airspace over the high sea, chapter V. focuses on the issues of treatment of airspace in the event of emergency situations. The need to develop international-law standards regulating this area emerged basically together with the origin of aviation. efining this assistance for aircraft in emergency over the sea – more specifically over the high seas. Chapter VI. addresses the issue of combating crimes against civil aviation. For a relatively long time this issue has been legally addressed only in terms of damaging aviation technology and equipment. The most dangerous form of such crimes – aircraft hijacking and shooting down, including abuse of aircraft as a tool for a terrorist attack. Due to the existence of Tokyo, Hague, and Montreal conventions and clause 3bis of the Chicago convention we can say that this area is very well regulated from the international-law perspective. The conclusion of the thesis focuses on the activities of the European Union in the area of understanding state sovereignty. Creation of the so-called functional blocks of airspace within the Single European Sky project regardless of geographical borders of the individual states in order to ensure further development of civil air transport. This project also represents a great challenge and task for the international law to create quality legal regulation which will ensure the fulfillment of the states’ justified requirements for guaranteeing their sovereign functions within their airspaces and also contribute to further development of safety, quality and efficiency of international civil aviation.
