Restitution of Ecclesiastic Property

Abstract:

K řešení problému církevních restitucí přistoupila Česká republika s více jak 20 letým zpoždění. Cílem této práce je zjištění aktuální právní úpravy, kterou v současné době představuje schválený zákon č. 428/2012 Sb., o majetkovém vyrovnání s církvemi a náboženskými společnostmi, účinný od 1. 1. 2013. Autor práce ve své snaze poskytnout ucelený pohled na tuto problematiku, po uvedení a vysvětlení základních pojmů, se krátce věnuje historickým souvislostem, ze kterých plynně přechází do současné doby a ke stěžejní části své práce, kterou je rozbor a komentář nově přijatého zákona o majetkovém vyrovnání.

Abstract:

The Czech Republic approached the problem of the ecclesiastic restitution with a more than 20 years delay. The aim of this study is to determine the current legal regulations which are actually presented by the passed Act No 428/2012 Coll., “About property settlement with churches and religious communities”, effective since 1. 1. 2013. The authoress of the study, in the effort to provide a comprehensive view at this issue, deals briefly with an introduction and explanation of the basic terms. The historical context follows and she proceeds to the contemporary time and to the central part of her study – the analysis and commentary of the newly passed Act on the property settlement.
