Anotace:

Anotace: Správní řízení před katastrálním úřadem The administrative proceedings before the Real Estate Registers authotities Prvně představen katastr nemovitostí jako systém, obsah, funkce a organizacční struktury. Rozbor vkladového řízení, podání návrhu na vklad, zákonné náležitosti. Popsán průběhu řízení,typy rozhodnutí, jako je přerušení,zastavení řízení,rozhodnutí o povolení návrhu na vklad do katastru, zamítnutí a podání žaloby podle občanského soudního řádu. Platnými právními předpisy. Speciálním zákon č. 265/1992 Sb., o zápisech vlastnických a jiných práv k nemovitostem, ve znění pozdějších změn, zákonem č. 344/1992 Sb., o katastru nemovitostí ČR(katastrální zákon). Obecný zákon č. 500/2004 Sb., správní řád, Podrobnější úpravu obsahu katastru, činností při správě katastru, postupů při vkladovém řízení, obnově katastrálního operátu a zeměměřických činnostech a zajišťování geodetických podkladů představuje vyhláška ČÚZK č. 26/2007 Sb., kterou se provádí zákon č. 265/1992 Sb., o zápisech vlastnických a jiných práv k nemovitostem ve znění pozdějších změn a zákon č. 344/1992 Sb., o katastru nemovitostí České republiky (katastrální zákon), v platném znění, (katastrální vyhláška). Správní orgány vychází ze správního zákona, tak i zásady, vyplývající z nového správního řádu, jsou podstatným znakem správního řízení a správní orgány jsou povinny se jimi řídit. Zsady vkladového řízení, a to zásady priority, legality, zásady dispoziční a konstitutivní. Práce je v této souvislosti zaměřena na správní činnost katastrálních úřadů. Jsou popsány rozhodovací činnosti ve formě správního řízení, které se provádí jak u vkladového řízení, tak i při porušení pořádku na úseku katastru nemovitostí nebo při řízení o námitce proti obsahu obnovy katastrálního operátu a řízení o označení hranice na náklad vlastníka. Další část práce se týká obnovy katastrálního operátu, jehož právní úprava je obsažena v katastrálním zákoně a v prováděcí katastrální vyhlášce. Katastrální vyhláška se mimo tuto problematiku zaměřuje též i na zeměměřické a geodetické podklady. Popisuje zde tři způsoby jejího provádění, od fáze způsobu oznamování na základě pravomocného rozhodnutí obcí, samotné realizace a vyhlášení platnosti obnoveného katastrálního operátu. Jako forma správního řízení je zde podtrženo řízení o námitce se všemi svými důsledky. V obsahu práce je poukazováno na problematiku a využití právní úpravy vyplývající ze všech souvisejících předpisů a odkazováno na konkrétní paragrafy, které se vztahují k popisované problematice. Jsou zdůrazněny některé vazby mezi jednotlivými předpisy s vysvětlivkami nebo odkazy „pod čarou“. Pro vysvětlení jsou popsány některé příklady z praxe. V textu se můžeme setkat i s příklady popisujícími problematiku s využitím judikatury z rozhodovací činnosti jak katastrálních úřadů, tak i příslušných soudů. Práce také vyzdvihuje další právní předpisy, kterých se problematika na úseku katastru nemovitostí týká.

Annotation: The Administrative Proceedings before the Land Registries For the reader to better orientate in the part which is a basis of this paper the Cadastre, as a system including the contents, functions and organizational structure thereof, has been first introduced to him. The fundamental part of the paper lies in the analysis of the entry procedure. An emphasis has been placed on filing a motion for the entry, the statutory elements thereof and annexes thereto. The attention is also paid to the course of the proceedings and the types of the decisions such as the suspension or discontinuance of the proceedings or the decision on the permission of the motion for the entry in the Cadastre or the dismissal and filing a petition according to the Civil Procedure Code have been defined. The valid legal regulations have been utilized. The administrative proceedings are governed by special Act No. 265/1992 Coll., on the entry of ownership and other titles to real estate as amended, and Act No. 344/1992 Coll., on the Cadastre of the Czech Republic (Cadastral Act). The subsidiary position towards the administrative proceedings has general Act No. 500/2004 Coll., the Rules of Administrative Procedure, which came into force on 1 January 2006 and fundamentally influenced the administrative activities of the administrative bodies and replaced valid Act No. 71/1967 Coll., on the administrative proceedings (Rules of Administrative Procedure) which was not amended from the beginning and was amended after 2000 by three amendments. More detailed regulation of the contents of the Cadastre, the activities relating to the administration of the Cadastre, the procedures with respect to the entry procedures, the renewal of the cadastral documentation and the land surveying activities and ensuring the geodetical bases have been stipulated in the new regulation of the COSMC No. 26/2007 Coll. by which Act No. 265/1992 Coll., on the entry of ownership and other titles to real estate as amended and Act No. 344/1992 Coll., on the Cadastre of the Czech Republic (the Cadastral Act) as amended have been implemented (the cadastral regulation). Since the administrative bodies are obliged to adhere to the administrative law act, also the principles arising from the provisions of the new administrative law act are an important point with respect to the administrative proceedings and the administrative bodies are obliged to observe them. The principle thereof has also been applied to the activity of the administrative bodies in the section of the Cadastre. Therefore the chapter focusing on the principles of the entry procedure, such as the principle of priority, legality, the disposition and constitutive principles, has been incorporated in the text of the paper. In this respect the paper focuses on the administrative activity of the Land Registries. The decision-making activities in the form of the administrative proceedings which are carried out both with respect to the entry procedures and to the breach of the order in the section of the Cadastre or to the proceedings on the objection to the contents of the renewal of the cadastral documentation and the proceedings on the marking of the border at the expense of the owner have been described. The other part of the paper deals with the renewal of the cadastral documentation the legal regulation of which has been included in the Cadastral Act and in the implementing cadastral regulation. In addition to this issue the cadastral regulation focuses also on the land surveying and geodetical bases. I describe herein three ways of the implementation thereof beginning with the manner of the notification under a final and conclusive decision of the municipalities, the implementation itself and the declaration of the effect of renewed documents of cadastre. use of the legislation arising from all related regulations and refers to the particular sections relating to the issue described. There have been highlighted some links between separate regulations and explanatory notes or the links “below the line“. For the explanation some practical cases have been described. The text also includes, for example, the cases describing the issue by using the decisions of the courts from the decision-making activity of both the Land Registries and the competent courts. Furthermore, the paper refers to some other legal regulations relating to the issue in the section of the Cadastre. The whole text indicates that such issue is connected with other regulations a list of which forms an annex to this paper.
