Proces oddlužení z pohledu insolvenčního soudu

Procedure of Debt Discharge from the Point of View of an Insolvency Court
Abstract:
Oddlužení je jedním ze způsobu řešení úpadku. Oddlužení je přípustné u dlužníka, který není podnikatelem. Jedná se o sanační způsob řešení úpadku, neboť při splnění podmínek stanovených insolvenčním zákonem je dlužník osvobozen od placení pohledávek, přestože uhradil pouze jejich část.
Abstract:
Discharge of debts is a form of insolvency resolution. Discharge of debts is acceptable as a resolution of state of insolvency of non-entrepreneurs. That is a preservation method of insolvency resolution because the debtor is exempted from the rest of his debts after he had fulfilled all conditions laid down by the Insolvency Act. The debtor is exempted although he had paid only part of his debts.
