The financial law aspects of retirement savings

Abstract:

Jako téma své diplomové práce jsem si vybrala Finančněprávní aspekty důchodového spoření. Cílem práce je podrobně popsat a seznámit čtenáře s problematikou důchodového spoření v České republice. Hlavní náplní práce je popis a porovnání změn, které nastaly v důchodovém systému v posledních letech. V práci je především popsán důchodový systém používaný do konce roku 2012. Další částí práce je charakteristika důchodové reformy, která nabyla účinnosti k 1. 1. 2013. Zabývám se tedy komparací stavu před a po roce 2013 a podrobněji popisuji jednotlivé pilíře důchodového systému. Dále se zaměřuji na finančněprávní aspekty důchodového spoření. Součást mé práce také tvoří kapitola zabývající se finančněprávními nástroji optimalizace důchodového systému. V neposlední řadě se v práci zabývám zrušením druhého pilíře. Na konec jsem uvedla současný stav důchodového systému, tedy stav, který je v České republice platný od roku 2016.

Abstract:

As a topic of my Thesis I have chosen The financial law aspects of retirement savings. The main goal of my work is to inform readers and describe in detail the problematics of retirement savings in Czech Republic. The main content is the description and changes comparing which have happened in retirement system in last years. Especially I described the retirement system used until the end of 2012, in my Thesis. The next part of my work is the characteristic of retirement reform, which have come into force on 1st January 2013. So I deal with comparison of condition before and after the 2013 and I describe in detail particular pillars of the retirement system. Next I focus on financial law aspects of retirement savings. Another part of my work is also the chapter following up financial law instruments of retirement system optimization. Last but not least I describe the canceling of second pillar. In the end I present current condition of retirement system which is valid in Czech Republic since 2016.
