Protection of Employe’s Personality in Labour - Law Relations

Abstract:

Práce se zabývá významnou oblastí pracovního práva, které je běžnou součástí většiny našeho života. Cílem není významný objev v legislativě pracovněprávních vztahů, ale zejména popsání a analýza možných rizik v pracovněprávních vztazích ve spojení s ochranou osobnosti zaměstnance. Jedná se o přehled obecných poznatků z pracovního práva, který je určen laické veřejnosti – řadovým zaměstnancům i zaměstnavatelům. Práce je zaměřena především na legislativní ochranu zaměstnance v České republice, na úzké propojení pracovního a občanského práva v rámci pracovněprávních vztahů a na zakotvení antidiskriminačního zákona do právního řádu.Jednotlivé části práce obsahují charakteristiku pracovněprávních pojmů,zaměření na problematiku rizikových oblastí při ochraně osobnosti zaměstnance, jejich popis a analýzu, popis právní ochrany osobnostních práv v České republice i v evropském právu a stručnou judikaturu českých soudů i evropského soudního dvora.

Abstract:

The work expresses an appealing area of the labour law which is an ordinary part of the most of our lives. The objective is not a significant discovery in the legislature field of labour-law relations, though, but it is a description and analysis of risk in the labour-law relations in connection with protection of an employee’s personality. It is all about summary of common cognisance out of labour law which is settled for laic public – ordinary employees and employers. The work is especially focused on legislative protection of an employee in the Czech Republic, then onto a close interconnection between Labour and Civil Law in the frame of labour-law relations and also onto anchorage of anti-discriminatory law into the Judicial Code.Individual parts of the work express the characteristics of labour-law concept, focusing onto the problematic of risk areas in terms of personality protection of an employee as well as their description and assessment, description of legal protection of personality rights in the Czech Republic and also in the European Law and brief judicature of Czech courts and also the European Court of Justice.
