The prayers for relief

Abstract:

Diplomová práce se zaměřuje na jednu z nejdůležitějších náležitostí žaloby, kterou je žalobní petit. Předmětem práce je analýza nejproblematičtějších otázek, které se k žalobním petitům vážou, zejména se jedná o problémy týkající se míry určitosti žalobního petitu, mezí vázanosti soudu žalobním petitem a výjimek z této vázanosti. Dále se práce soustřeďuje na jednotlivé druhy žalobních petitů, kdy největší pozornost je věnována petitu určovací žaloby a zvláštnímu druhu složeného petitu alternativa facultas, u nějž je významná zejména otázka jeho uplatnění v praxi. Vzhledem k tomu, že zákonná úprava žalobních petitů je v současné době nedostatečná, obecná či v určitých oblastech úprava zcela chybí, je důležitým informačním zdrojem diplomové práce soudní judikatura, a to především judikatura Ústavního a Nejvyššího soudu. Velkou část práce pak zaujímají konkrétní příklady z praxe, na základě kterých jsou pak učiněny závěry, jež jsou stěžejní pro odpovědi na výzkumné otázky. S ohledem na skutečnost, že v současné době probíhají přípravy nového civilního řádu soudního, je diplomová práce doplňována úvahami o možné budoucí úpravě otázek souvisejících s problematikou žalobních petitů.

Abstract:

The diploma thesis focuses on one of the most important elements of the action, which is the demand for relief. The subject of the thesis is an analysis of the most questionable issues that relate to the demands for relief, especially the issues of degree of certainty of the demand for relief, bounds of the binding of the court by the demand for relief and exceptions to the binding. The thesis also focuses on individual forms of demand for relief when the greatest attention is paid to the declaratory action and to the special form of compound demand for relief alternative facultas in which the question of its application in practise is particularly significant. Given that the legal regulation of the demand for relief is currently insufficient, general or in some areas is completely absent, case law of the Constitutional and Supreme court is an important source of information for the thesis. A large part of the thesis then covers specific cases from practise on the basis of which conclusions are made that are relevant for answers to research questions. In view of the fact, that the preparations for the new code of civil procedure are currently taking place, the diploma thesis is complemented by the reflections about the possible future regulation of questions related to the issue of demands for relief.
