The Conflict between Principle of Professionality and Protection of the Weaker Party in the New Civil Code

Abstract:

Tato práce se zabývá možnostmi konfliktu a vzájemné interakce dvou významných zásad nového občanského zákoníku, jimiž jsou zásada profesionality a zásada ochrany slabší strany, když tyto jsou uvažovány zejména z hlediska podnikatelského styku. Na úvod práce stručně definuje pojem podnikatele a standard obecné a odborné péče. Meritorní část práce pojednává o konkrétních případech, v nichž se dle nového občanského zákoníku konflikt zmíněných zásad projevuje. V závěru jsou shrnuty poznatky práce a navrženy některé změny právní úpravy.

Abstract:

This thesis deals with the possibility of conflict between two major principles of the new Civil Code and their interaction. Namely the professionalism principle and protection of weaker party particularly considered in terms of business practice. The beginning of this thesis focuses on succinct definition of an entrepreneur and standard of general and specialist care. The substantive part of this thesis deals with specific cases in which, according to the new Civil Code the conflicts of the mentioned principles are manifested. The conclusion summarizes the findings and outlines suggestions for legislation amendment.
