Management of Enforceable Tax Claims in the Czech republic

Abstract:

V této diplomové práci se zaměřuji na vymáhání daňových nedoplatků s cílem poskytnout ucelený pohled na tento proces, od vzniku nedoplatku až do jeho zániku, ať již uhrazením nebo uplynutím prekluzivní lhůty a současně poskytnout přehled všech zákonem daných možností jednotlivých způsobů vymáhání a zhodnocení jejich efektivnosti. Výběr daní je v každé společnosti citlivým a často diskutovaným tématem, které lze nahlížet z pohledu daňových poplatníků a tedy nás všech, z pohledu těch, kteří daný systém vytvářejí, tedy zákonodárců a politických vůdců, jakožto autorů zákona o státním rozpočtu a současně z pohledu vykonavatele práva daně vybrat. Domnívám se, že spojení těchto třech úhlů pohledu napomáhá vytvoření celkového obrazu nejen systému vybírání daní, ale také obrazu celé společnosti, ve které prozatím neplatí, že platit daně je normální.

Abstract:

In this thesis I focus on the enforcement of tax arrears with the aim to provide a holistic view of this process, from the beginning of arrears until its demise, either by payment or expiry of a limitation period and also to provide an overview of all legal possibilities of individual methods of enforcement and evaluation of their effectiveness. Tax collection is sensitive and often discussed topic in every society, which can be viewed from the perspective of taxpayers, and therefore all of us, from the perspective of those who create the system, that legitators and political leaders, as the authors of the law on the state budget and also from the perspective of law enforcement officers taxes select. I belive that the combination of theese three perspectives helps to create an overall picture not only of collection taxes, but also of the image of the whole society, in which does not apply, it is normal to pay taxes.
