The analysis of a chosen dispute in WTO

Abstract:

Cílem této diplomové práce bylo představit pomocí analýzy vybraný spor v rámci Světové obchodní organizace a jeho kontext, zhodnotit dopady rozhodnutí v tomto sporu a na základě analogií aplikovat zjištěné skutečnosti na současné obchodněpolitické tendence. Vybraným sporem byl spor DS 248 o ochranná opatření na dovoz určitých produktů z oceli mezi EU jako stěžovatelem a USA jako odpůrcem. Diplomová práce se skládá ze 4 částí. První část se zabývá ochrannými opatřeními obecně, v pravidlech WTO a v americké legislativě. V druhé části je analyzován kontext sporu z pohledu světového trhu oceli a domácích trhů oceli v EU a USA. Třetí část je zaměřena na vybraný spor ve WTO, je zde popsáno sporné opatření, argumentace EU a USA a stručně představeny třetí strany sporu. Ve čtvrté části je rozebrán závěrečný verdikt společně s jeho dopadem na obchod a v závěru jsou aplikovány nálezy z toho sporu na současná opatření USA na dovoz oceli.

Abstract:

The aim of this diploma thesis was to present by analysis a chosen dispute in the World Trade Organization and its context, evaluate an impact of conclusions in this dispute and, based on analogies, apply found facts on current trade-policy tendencies. The chosen dispute was dispute DS248 on safeguard measures on imports of certain steel products between EU as complainant and USA as respondent. The diploma thesis consists of 4 parts. The first part deals with safeguard measures in general, in WTO rules and in American legislation. In the second part is analysed the context of the dispute from the point of view of the world steel market and domestic steel markets in EU and USA. The third part is focused on the chosen dispute in WTO, there is described a disputed measure, argumentation of EU and USA and briefly introduced third parties of the dispute. In fourth part is analysed final conclusions in the dispute together with its impact on trade and, in the end, findings in this dispute are applied on current US measures on steel import.
