Criteria of public-interest journalism

Abstract:

Tato bakalářská práce se zabývá vztahem veřejného zájmu a novinářské praxe. Pokud novinář potřebuje pro získání informace porušit osobnostní práva člověka, je jeho zásah ospravedlnitelný právě veřejným zájmem. Tento pojem však není v mediální oblasti definovaný, tudíž nelze s jistotou určit, který zásah bude s ohledem na veřejný zájem legitimní. První část práce vymezuje veřejný zájem v oblasti praktické žurnalistiky, druhá část práce teoreticky vymezuje právní a etické omezení novináře při odhalování informací ve veřejném zájmu. Na základě analýzy relevantních dokumentů a následné syntézy získaných poznatků byla utvořena základní kritéria, jejichž posouzení novináři usnadní rozhodování, zda lze jeho zásah do osobnostních práv ospravedlnit veřejným zájmem. Pro lepší pochopení jsou jednotlivá kritéria v případě potřeby doplněna příklady z novinářské praxe, popř. soudními rozhodnutími.

Abstract:

This thesis is concerned with the relation between the public interest and the journalistic practice. When a journalist needs to intervene personal rights for getting information, this intrusion can be justifiable by the public interest. However this term is not defined in media sphere, thus there is no certainty whether the intrusion is legitimate. The first part specifies the public interest in the area of practical journalism. The second part specifies legal and ethical limits for journalists while they are trying to explore information in the public interest. Based on the analysis of relevant documents and subsequent synthesis of learned findings basic criteria were formed in order to help the journalist to make a decision whether his intervention into personal rights can be justified by the public interest. Some of the criteria are completed by examples of journalistic practice or judicial decisions for a better understanding.
