Analysis of Old Age Pension in the Czech Republic

Abstract:

Tématem diplomové práce je problematika starobních důchodů v České republice. Cílem práce je provedení analýzy starobních důchodů, včetně právní úpravy, jejího vývoje a definování hlavních problémů důchodového systému a návrhy jejich řešení. Meritum práce je soustředěno na starobní důchod jako dávku důchodového pojištění, vymezení důchodového schématu a rozbor jeho jednotlivých prvků včetně analýzy důchodové formule starobního důchodu. Účelem diplomové práce je analyzovat starobní důchody, objasnit a rozebrat jednotlivá hlediska starobních důchodů. V případě zjištění nedostatků v právní úpravě, provést návrhy de lege ferenda a definovat problémy I. pilíře důchodového systému České republiky a navrhnout jejich řešení. Pro I. pilíř důchodového systému ČR jsou charakteristické reformní změny jeho právní úpravy, první nejvýznamnější bylo přijetí zákona č. 155/1995 Sb., o důchodovém pojištění, s účinností od 1. 1. 1996, která vrátila do důchodového pojištění pojišťovací princip. Komparací § 15 odst. 3 zákona č. 155/1995 Sb., ve znění pozdějších předpisů, který upravuje výši redukčních hranic, ve znění před novelizací zákonem č. 220/2011 Sb., s účinností od 30. 9. 2011 a po ní, jsem došla k závěru, že pro pojištěnce s vyššími příjmy je výpočet starobního důchodu výhodnější podle nové právní úpravy. Po formulování problémů I. pilíře důchodového systému jsem došla k závěru, že pro jeho stabilizaci je nezbytné zavedení razantnějšího prodlužování důchodového věku, zpřísnit podmínky pro přiznávání tzv. předčasných starobních důchodů, omezit valorizace důchodů, případně zvážit zavedení zaměstnaneckého pojištění do podnikových fondů, do kterých by povinně odváděli pojistné jak zaměstnanci, tak zaměstnavatelé.

Abstract:

The topic of that thesis is an issue of old-age pension in the Czech Republic. The aim is an analysis of an old-age pension including its law adjustment, evolution and to define the main issues of the old-pension scheme and the proposal of its solutions. The main part of that thesis is an old-age pension as the pension benefit, the demarcation of the old-age pension scheme and the analysis of its parts including the old-age pension calculating formula. The purpose of that thesis is also to analyze an old-age pension, to clarify and to explore its individual aspects. In case of some lacks there will be done a de lege ferenda proposals. Next aim is to define the troubles of the First pillar of the pension security scheme in the Czech Republic and to propose its solutions. The First Pillar of the pension security scheme in the Czech Republic is characterized by reforming changes of its legislation adjustments. The most important change is an adoption of the Act No. 155/1995 Coll., on pension insurance with effect from 1st January 1996. This adjustment has returned to the old-age pension an insurance principle. After the comparison of the Section 15 (3) of the Act No. 155/1995 Coll. as amended, which modified the amounts of the reduction limits, in version before the amendment no. 200/2011 Coll. with effect from 30th September 2011 and after that amendment, I can conclude that the calculation of old-age pension after the amendment is preferable for insurance holders with higher salary. After the formulation the Firs Pillar of the pension security troubles I concluded that for the stabilization of that pillar is necessary to install a penetrative protraction of the retirement age, to toughen the conditions for entitlement to early retirement pensions, to limit an indexation of old-age pensions, to consider an introducing of staff insurance to a company's insurance funds, where it would be a duty to pay a premium both employees and employers.
