Abstract:

Licenční smlouva je z podhledu tvůrčích osobností velmi důležitým instrumentem, jenž je upraven v autorském zákoně, který chrání autorská práva, jež se vyvíjela dlouhá staletí. Proto diplomová práce Licenční smlouva začíná historickým vývojem autorskoprávní ochrany. Poté se plynule přechází na široký pojem autorského práva, kde se autor věnuje problematice autorského díla, autorství a jejich ochrany. Třetí část se věnuje již samotné licenční smlouvě, která chrání práva autorů vůči nabyvatelům licence. Zde je charakterizována licence a její typy a následně náležitosti smluv a možnosti odstoupení nebo naopak rozšiřování v podobě podlicencí. V poslední kapitole se pak analyzuje konkrétní smlouva z praxe, zda je v souladu se zákonem či nikoliv.

Abstract:

Licence agreement is an important instrument from an author's view which is regulated by copyright law. Copyright law is a form of protection which has been evolved over centuries and that is the reason why begins this diploma thesis with historical development of copyright protection. Next part is devoted to broad concept of copyright law which deals with copyright, authorship and their protection. Third part is devoted to license agreement, which protects author's law against licensees. Here is characterized license, their types and requisites of contracts and the possibility of cession or, conversely, expansion in the form of sublicenses. The final chapter then analyzes the practice of a particular contract, whether it is in accordance with the law or not.
