Abstract:

This diploma thesis aims to study legal conditions in national and European legislative frameworks, as well as to present complicated information about intellectual property and its protection in the European Union (EU). This thesis will attempt to address the questions of whether intellectual property rights (IPRs) are adequately protected in the European Union (EU) and what drives consumer demand for counterfeit goods. The thesis examines how knowledge and information are disseminated in order to accomplish these objectives. Definitions of intellectual property, its classifications, and an examination of the legal systems will all be included in the summary. The goal of Intellectual Property Rights (IPR) is always to safeguard the rights of creators. While the recognition of writers' rights in their works marked the beginning of this protection, modern technology has fundamentally changed the nature and use of works. The evolution of intellectual property rights (IPR) history also demonstrates how the state gradually acknowledged the author's original intellectual effort and awarded them limited proprietary rights. This thesis examines the moral and economic rights of writers of various kinds of works as well as the judge's perspective on how those rights should be understood.
