Evaluation of the Concept and Functioning of the Investment Incentives

Anotace:

Tato práce se zabývá rozborem konceptu investičních pobídek v České republice a zhodnocení jeho fungování. Cílem práce je vytvoření či vyvrácení hypotézy, že investiční pobídky jsou vhodným a potřebným nástrojem pro podporu podnikání a jejich právní zakotvení a efektivita fungování je dostatečná. Práce se zabývá systémem veřejné podpory v kontextu práva Evropské unie, analýzou jednotlivých forem investičních pobídek, syntézou již publikovaných analýz a zpráv na toto téma a komparací právních úprav s vybranými státy Evropské unie. Výsledkem je vymezení pozitivních a negativních momentů institutu investičních pobídek spolu s četnými návrhy na změny a dalšími možnostmi na zlepšení, případně návrhy alternativních konceptů podpory.

Abstract:

This thesis discusses the concept of the investment incentives in the Czech Republic and the evaluation of its functioning. The aim of the thesis is to create or refute the hypothesis that investment incentives are a suitable and necessary tool for business support and their legal base and the efficiency are sufficient. The thesis deals with the system of state aid in the context of the European Union law, the analysis of individual forms of investment incentives, the synthesis of already published analysis and reports on this topic and comparison of legislation with selected states of the European Union. The result is the definition of the positive and negative moments of the investment incentive institute along with many proposals for amendments and other options for improving or designing alternative support concepts.
