Generally Dangerous Crimes in Selected Countries. Comparative Legal Study

Abstract:

Záměrem této práce je porovnat různé způsoby vypořádávání se s těmi zločiny, které lze označit za „obecně nebezpečné“, na příkladu českého, polského, rakouského, francouzského a angloamerického přístupu. Nejprve se pokouší nalézt podstatu těchto trestných činů tím, že rozebírá jejich charakteristické rysy, přičemž za podklad slouží česká doktrína. Následně je předložena analýza právních řešení situací, které se vyznačují právě touto podstatou, v ostatních vybraných státech. Tato analýza je provedena postupně ve všech zemích, přičemž zpravidla se nejprve zaměřuje na historický vývoj těchto trestných činů, následně se pozornost přesouvá k poznatkům o nich v zákonodárství, rozhodovací praxi a teorii konkrétního státu. Na závěr je zařazena krátká syntéza závěrů.

Abstract:

The purpose of this thesis is to compare different ways of dealing with that sort of crimes, that can be labeled as “generally dangerous”, on examples of Czech, Polish, Austrian, French and Anglo-American approach. At first it tries to find the essence of such offences by analyzing its typical traits; this is done mainly on basis of Czech doctrine. After that, analysis of the legal solutions of situations, that are distinguished by this essence, in other selected countries is brought. This analysis is performed in the countries one by one and in regular it focuses on short description of historical development of these crimes at the begging, than it moves to statutory, judiciary and theoretical knowledge of them in the specific state. In the end a brief synthesis of gained conclusions is done.
