The Legal Aspects of Registration of Offenses

Abstract:

Evidence přestupků je novinkou v oblasti správního trestání v České republice zaváděnou od 1. října 2016. Je zřízena za účelem zpřísnění postihu recidivy vybraných druhů přestupků a umožnění lepšího posouzení přestupkové spolehlivosti určitých osob. Tato práce popisuje současný stav evidování přestupků a důvody pro zavedení centrální evidence přestupků. Rozebírá základní principy evidence přestupků – proč ji vede Rejstřík trestů, co se zapisuje, kdo má přístup k údajům, kdy se údaje vyřadí. Dále práce analyzuje, jaké budou nové postupy v souvislosti s evidencí přestupků v oblasti sankcí a přestupkového řízení. Práce obsahuje i stručnou komparaci se slovenskou právní úpravou obdobné evidence přestupků.

Abstract:

The registration of offenses, a novelty in the field of administrative punishment law in the Czech Republic, will be implemented on October 1st 2016. Its purpose is to tighten sanctions against recidivism of selected types of minor offenses and to facilitate assessment of offenders’ reliability. This bachelor thesis describes the current state of offence registration and the reasons for the introduction of a central registration of offenses. It analyzes the basic principles of the registration of offenses - why the registration will be operated by the Criminal Records Office, what will be registered, who is going to have access to the data and when the data are going to be discarded. The thesis also examines what consequences the register’s introduction would have in the area of sanctions and offence proceedings. It includes a brief comparison with the Slovak legislation of a similar registration.
