Salaries of Judges in the Czech Republic as a Constitutional Issue

Abstract:

Cílem této diplomové práce nebylo odpovědět na otázku, jestli je plat soudce dostatečně vysoký, nebo jak vysoký být má. Cílem této práce bylo analyzovat plat soudce, jeho právní úpravu, legislativní zásahy zákonodárce do hmotného zabezpečení soudců a provést rozbor judikatury Ústavního soudu. Práce obsahuje i komparaci platové problematiky a judikatury jiného demokratického státu. V České republice je již několik let tradicí, že se do platu soudce pravidelně zasahuje novelizací příslušného zákona, což pak působí dojmem, že soudcovský plat je možné jednoduše v případě nutnosti měnit, zmrazit nebo jinak upravovat, a to podle stavu ekonomiky státu a stavu státní kasy. Plat soudce je ve společnosti vnímán jako citlivé téma, kde se na jednu stranu staví názory laické veřejnosti, že se jedná o příliš vysokou částku a je možné ho pravidelně měnit zásahem zákonodárce, a na druhé straně stojí soudci, kteří pociťují tento zásah jako zásah do jejich práv. Laická veřejnost však většinou už nevnímá, co ta určitá výše platu soudce představuje, co má garantovat a zajišťovat jak pro osobu soudce, tak i pro společnost. Proto je v diplomové práci proveden rozbor právní úpravy dané problematiky, judikatury Ústavního soudu České republiky a zhodnocen současný stav a praxe zákonodárce při úpravách platů soudců. Závěr práce obsahuje celkové zhodnocení problematiky a vlastní názor.

Abstract:

The aim of this work is not to resolve the question whether the salary of a judge is sufficiently high, as high as it should be, but to point out the overall system and method of adjusting salary of a judge. The aim of this paper is to analyze the salary of a judge, his legislation, legislative interference with the financial security of judges and analyze the case law of the Constitutional Court. The salary of a judge is at a sensitive topic. On the one hand, there is general public opinion that is too high and can be changed regularly. On the other hand there are judges who feel the legislature steps as interference with their rights. However, the general public usually does not see what a certain height of salary represents for the judges, what salary should guarantee and financially secure both the judge and the society. In evaluating the issue of judges' salaries the most important attainment level is not the actual salary of a judge, but the system of this legislation and the legislative changes. The conclusion includes an appraisal of the salary issue and my opinion.
