Diversions in Criminal Proceedings from the View of Praxis

Abstract:

S nástupem společenských změn ve společnosti po roce 1989 se mění také požadavky kladené na postupy trestního řízení. Dosavadní postupy bylo třeba doplnit, nebo nahradit novými, a to především z důvodu vzrůstající kriminality ve společnosti a v důsledku toho zahlcení OČTŘ a soudů, způsobené složitým a zdlouhavým způsobem řešení trestních věcí a to i v případě méně závažných trestných činů. Z těchto důvodů zde vznikla potřeba možnosti projednat méně závažné trestné činy, s přihlédnutím k osobě pachatele, jinou, alternativní formou trestního řízení, čili užitím odklonu. Jelikož se jedná o postupy alternativní, vybočující z klasického průběhu trestního řízení, je zde třeba pečlivě zvažovat vhodnost jejich užití, především ve vztahu k osobě pachatele, okolnostem spáchaného trestného činu, způsobenému následku a možnosti jeho nápravy. Je zřejmé, že odklony jsou přípustné pouze u méně závažných trestných činů, přičemž jejich aplikace je vhodná zejména u trestných činů spáchaných z nedbalosti. V našem trestním řízení najdeme několik způsobů alternativních řešení trestních věcí, přičemž mezi nimi lze nalézt podstatné rozdíly a různé okolnosti a způsoby jejich užití, nicméně účel každého z těchto alternativních postupů je stejný, je to již výše uvedené zjednodušení a zrychlení trestního řízení, což v konečném důsledku znamená, krom jiného, také snížení nákladů na toto řízení. Z praktického pohledu lze výhodu užití odklonu spatřovat také ve spojitosti s formálním pojetím trestného činu, tak jak ho upravuje TrZ. Tedy možnost vést trestní stíhání u trestných činů, které sice naplňují znaky požadované TrZ, ale pro stupeň jejich společenské škodlivosti je poté možné jejich vyřešení odklonem, což kladně působí na celou společnost, neboť trestní řízení je pak chápáno jako účinný nástroj v boji proti kriminalitě z důvodu, že je patrná snaha řešit každý trestný čin a jsou nástroje pro jeho efektivní a jeho závažnosti odpovídající způsob vyřízení.

Abstract:

With the advent of social changes in society after 1989 also changes the requirements for procedures in criminal proceedings. Existing procedures had to be supplemented or replaced with new ones, especially from av because of increasing crime in society and consequently, congestion agencies involved in criminal proceedings and courts, due to complex and lengthy way of resolving criminal cases and even. For less serious offenses. For these reasons there was a need to discuss the possibility of less serious offenses, with taking into account the the offender, another alternative form of criminal proceedings, or use of deflections. Since it is an alternative procedure, deviate from classical course of criminal proceedings, there is a need to carefully consider the appropriateness of their use, especially in air to the offender, the circumstances of the crime committed, its consequences and its possible remedies. It is clear that departures are permitted only for less serious crimes, while their application is suitable in particular for offenses committed in negligence. In our criminal procedure several ways to find alternative solutions for criminal cases, and between them can be found substantial differences and different circumstances and methods of their use, however the purpose of each of these alternative procedures is the same, it is already above the simplification and acceleration of criminal proceedings, which ultimately means, among other things, also reducing the cista of this proceeding. Practical point of view the advantage is the use of diversion also be seen in connection with formal concept of crime as it adjusts criminal code. So the opportunity to prosecute for offenses which, although falling under the criminal code required, but thein degree of social harm is then possible to solve their departure, which positively affects the whole society, because the prosecution is seen as an effective tool the fight against crime because it reflects an effort to solve any crime and are effective tools for its seriousnessand its corresponding method of execution.
