Abstract:

V dnešní době je hospodářská kriminalita na vzestupu a finanční kriminalita je její součástí. Vedle korupce ve veřejné správě, podvodného jednání v souvislosti s privatizací a pojistných podvodů, jsou úvěrové podvody nebezpečím ohrožující banky i ostatní poskytovatele spotřebitelských i podnikatelských úvěrů. Pro pachatele trestných činů v oblasti podvodného jednání bývá realizace úvěrového podvodu většinou jediná příležitost, jak peníze rychle získat. Na rozdíl od pojistného podvodu není potřeba žádná počáteční investice (min. zaplacení pojistného) a proto je v poslední době i častější výskyt tohoto druhu trestné činnosti i mezi běžnými klienty bank i nebankovních společností. Tato bakalářská práce byla inspirována právě touto stále více narůstající problematikou úvěrových podvodů. Je rozdělena na tři velké oblasti této problematiky. První oblast Základní vymezení pojmů a charakteristika finanční kriminality jako celku a postupné zařazení problematiky podvodného jednání pachatelů finanční trestné činnosti pod konkrétní kategorie. Druhá oblast Odhalování a vyšetřování úvěrových podvodů, metodické postupy kriminalistického vyšetřování, typické stopy, které po sobě pachatelé zanechávají a je možné je na základě těchto stop odhalit a potrestat dle platné legislativy. Třetí oblast Ochrana a prevence před úvěrovými podvody je zaměřena na využití všech znalostí a informací získaných při odhalování a vyšetřování podvodných jednání směřujících k finanční trestné činnosti k prevenci a včasné detekci prvotních kroků pachatele, nejlépe tak, aby k dokonání trestné činu ani nedošlo a byl odhalen ve fázi přípravy či pokusu. Koncepcí této práce je seznámit čtenáře s tímto druhem majetkové trestné činnosti, s její společenskou nebezpečností a v neposlední řadě přiblížení kriminalistické metodiky jejího vyšetřování. Tato práce by měla napomoci k vyšší obezřetnosti při poskytování spotřebitelských i podnikatelských úvěrů, jak přímo poskytovateli, tak především zprostředkovateli dne zákona.

Abstract:

Nowadays, economic crime is on the rise and financial crime is part of it. In addition to corruption in public administration, fraudulent behavior in connection with privatization and insurance fraud, credit fraud is a threat to banks and other providers of consumer and business loans. For fraudsters in the area of fraudulent behavior, the implementation of credit fraud is usually the only opportunity to get money quickly. Unlike insurance fraud, no initial investment is needed (minimum premium payments), and this is why there is a more frequent occurrence of this type of crime among regular clients of both banks and non-bank companies. This bachelor thesis was inspired by this growing problem of credit fraud. It is divided into three major areas of this issue. The first area The basic definition of the concepts and characteristics of financial crime as a whole and the gradual inclusion of fraudulent behavior of financial crime offenders under specific categories. The second area of Credit Fraud Detection and Investigation, methodical procedures of criminal investigation, typical traces that the perpetrators leave behind and it is possible to reveal them and punish them according to the valid legislation. The third area Protection and Prevention of Credit Fraud is focused on the use of all knowledge and information gained in detecting and investigating fraudulent actions aimed at financial crime to prevent and timely detection of the offender's initial actions, preferably so that the offense is not even committed and revealed in the preparation or trial phase. The concept of this work is to acquaint the reader with this kind of property crime, its social danger and, last but not least, the approach of the criminalistic methodology of its investigation. This work should help to increase caution in the provision of both consumer and business loans, both directly to the provider and, above all, to the day-law intermediary.
