Powers of the European Union and the European Community now and according to the Constitutional Treaty

Abstract:

Práce je zaměřena na vymezení (s ohledem na přesnost, transparentnost, vyváženost) klíčových kompetencí EU/ES (Unie) dnes a podle Ústavní smlouvy s výhledy de lege ferenda, včetně stanovení limitů výkonu kompetencí (principy subsidiarity a proporcionality), to vše se zvláštním ohledem na kompetence členských států (vertikální dělba kompetencí). Vstup do kompetenční problematiky je zahájen úvahou, zda lze o Unii uvažovat jako o federaci. Na to navazuje exkurz rekapitulující kompetenční ustanovení a jejich „ústavní život“ v ústavě Německa a USA. Poté se již věnuji jednotlivým klíčovým aspektům současného kompetenčního uspořádání, jakož i úpravě, kterou navrhovala Ústavní smlouva, přičemž uvažuji o budoucí vhodné úpravě. Po zdůraznění principu svěřených pravomocí se pokouším o hlubší analýzu a odhalení potenciálu principů subsidiarity a proporcionality, které mají klást meze výkonu kompetencí EU/ES. Následně se zabývám harmonizační kompetencí podle čl. 95 SES, pokračuji rozborem subsidiární kompetence podle čl. 308 SES, implikovanými a implicitními vnějšími kompetencemi. V další části práce se zabývám kategorizací kompetencí na výlučné, sdílené (konkurující, resp. paralelní) a podpůrné, které vypovídají o přípustné intenzitě a míře aktivit EU/ES vůči členským státům. V této souvislosti upozorňuji na tzv. kompetenční dynamizmus a uplatnění preempce. Poté ilustruji obtížnost jasného rozdělení kompetenčních sfér mezi EU/ES a členskými státy na příkladech z oblasti životního prostředí a volného pohybu vysokoškolských studentů. Nakonec se pokouším o hodnocení kompetenční kategorizace (na kompetence výlučné, sdílené a podpůrné) obsažené v Ústavní smlouvě, a to i s ohledem na možnou úpravu de lege ferenda.

Abstract:

In my master thesis I focused mainly on the vertical division of powers between the Union and its member states and the limits of their exercise. First I considered the nature of the EU/EC legal order in terms of federation and federalism. I pointed to some federal characteristics within the current legal order of the EU/EC. Then I showed that the competence order between the Union and its member states may be compared (bearing in mind many essential differences) with the federal division of powers. In this respect I briefly examined the vertical divison of (mainly legislative) powers in Germany and the USA. After such an introduction, I turned to the main subject of my thesis – Powers of the European Union and the European Community now and according to the Constitutional Treaty. I started with the principle of attributed (conferred) powers. Then I examined the principles of subsidiarity and proportionality. I stressed the potential of these principles and suggested some recommendations as regards more balanced exercise of the Union's powers (competences) de lege ferenda. Afterwards, I focused on the most important and problematic competence provisions – general functional powers (harmonisation competence under article 95 and subsidiary competence under article 308 TEC). I also examined implied competences and implicit external comptences. Then I explored the categories of the EU/EC competences. According to the intensity of the EU/EC action in the specific policy areas, I showed in my thesis that we can distinguish exclusive, shared (concurrent and parallel) and supportive competences. Consequently, two samples (the first from the area of environment, the second in the field of education and equal treatment of migrant university students) have been chosen to exemplify the complexity of the current competence order with the blurred competence borders between the Union and the member states. Finally, I pointed to the classification of the Union’s competences (exclusive, shared, supportive) and the areas falling into each category, as provided for by the Constitutional Treaty. In this respect, I emphasized the proposed improvements, but I did also made some critical remarks and a few suggestions for the future.
